18 Section 1. Section 252.63, Florida Statutes, is
19 created to read:
20 252.63 Florida Disaster Supplier Program Council.--
21 (1) The Florida Disaster Supplier Program Council is
22 created under the Department of Community Affairs.
23 (a) The council shall consist of seven members,
24 comprised of one county emergency management director from
25 each of the seven Division of Emergency Management operational
26 regions, as designated by the Florida Emergency Preparedness
27 Association. The council shall make recommendations for a
28 voluntary local program to be established as the Florida
29 Disaster Supplier Program. The intent of the Florida Disaster
30 Supplier Program is to establish statewide oversight of the
31 availability and provision of necessary supplies prior to,

1 during, and following a state of emergency or natural or
2 manmade disaster or catastrophe. The disaster supplier program
3 shall allow businesses to voluntarily participate in the
4 program and provide for the sale of emergency-use supplies and
5 services before, during, and following an emergency or
6 disaster under the conditions set forth in this section. The
7 Disaster Supplier Program Council shall recommend guidelines
8 and administration standards for participating counties.
9 Participation in the program shall be at the option of each
10 county governing body within the state. Each county choosing
11 to participate in the program shall be responsible for
12 administering the program within that county.
13 (b) The Florida Disaster Supplier Program shall be
14 designed so as not to interfere with the normal and ongoing
15 commerce occurring in any political subdivision of the state.
16 The intent of the program is to assist in the rapid recovery
17 of an area affected by a manmade or natural disaster and to
18 stimulate local economies immediately in a postdisaster
19 recovery. Additionally, this program shall be designed to
20 provide the public with alternative access to certain
21 commodities as recommended by the council.
22 (c) The members of the council shall elect a chair and
23 a vice chair from among their membership. The chair shall
24 preside at all meetings of the council.
25 (d) The council shall meet at the call of the chair or
26 at the request of a majority of its membership.
27 (e) Members shall serve for the duration of the
28 existence of the council. A vacancy on the council shall be
29 filled by the chair according to the original membership
30 stipulations until the council is terminated.
31 (f) Members of the council shall serve without

1 compensation, but are entitled to per diem and travel expenses
2 as provided in s. 112.061 while engaged in the performance of
3 their official duties.
4 (2) Duties and responsibilities of the council shall
5 include, but are not limited to, recommending to the division:
6 (a) State disaster preparedness criteria necessary for
7 implementation of the program.
8 (b) Methodology for granting access to participating
9 business for means of operating, supplying, and staffing of
10 their business units in times of emergency when and where
11 feasible under the existing emergency conditions.
12 (c) A statewide system of certification for disaster
13 suppliers in the following categories: pharmaceutical, food
14 and water, building supplies, ice, and other suppliers as may
15 be necessary.
16 (d) The possible assessment of an annual program
17 membership fee for businesses voluntarily seeking to obtain
18 certification as a state disaster supplier under the
19 established program guidelines. The determination of the
20 applicability or nonapplicability of any fees shall include
21 county surveys and input from business, industry, and state
22 agencies enumerated to establish the requirements for any
23 necessary fees. Any recommendation concerning fees shall be
24 contained in the report required in subsection (6).
25 (e) A State Emergency Response Team (SERT) logo that
26 bears the name of the state and the type of supplies being
27 provided by the supplier, to be displayed by businesses
28 participating in the voluntary program.
29 (3) Upon the recommendations of the council,
30 certification of a business requesting to participate in the
31 program shall be conducted through county emergency managers

1 or designees as set forth by the county's elected governing
2 body. Participating counties shall use the certification
3 standards developed by the Florida Disaster Supplier Program
4 Council.
5 (4) If applicable, methods for collecting program
6 membership fees shall be determined by the council. If
7 applicable, program membership fees collected shall be used in
8 whole or in part to recover the administrative cost of the
9 program and as recommended by the council.
10 (5) If applicable, program membership fees shall be
11 used by the participating counties and state agencies as
12 determined by the recommendations of the council and provided
13 by law.
14 (6) The council shall submit a report on the
15 development and implementation of the program to the Governor,
16 the President of the Senate, and the Speaker of the House of
17 Representatives no later than February 1, 2007. The report
18 must include recommendations for any needed legislation and
19 recommended fees with respect to the program and its effect on
20 the provision of supplies within the state during a state of
21 emergency or natural or manmade disaster or catastrophe.
22 (7) The council shall terminate on July 1, 2008.
23 Section 2. This act shall take effect July 1, 2006.
