1 A bill to be entitled

4 title; creating the Florida Disaster Supplier
5 Program; providing purpose of the program;
6 creating the Florida Disaster Supplier Program
7 Committee; providing purpose, membership,
8 terms, and organization of the committee;
9 providing duties and responsibilities of the
10 committee; requiring a report; providing for
11 termination of the committee; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Section 252.63, Florida Statutes, is
17 created to read:
18 252.63 Florida Disaster Supplier Program.--
19 (1) SHORT TITLE.--This section may be cited as the
20 "Florida Disaster Supplier Program Act."
21 (2) FLORIDA DISASTER SUPPLIER PROGRAM.--The Florida
22 Disaster Supplier Program is created within the division for
23 the purpose of providing statewide oversight of the
24 availability and provision of necessary supplies prior to,
25 during, and following a state of emergency or natural or
26 manmade disaster or catastrophe. Participation in the program
27 shall be at the option of each county governing body within
28 the state. Each county choosing to participate in the program
29 shall be primarily responsible for administering the program
30 within that county.
31 (3) FLORIDA DISASTER SUPPLIER PROGRAM COMMITTEE.--

1 (a) There is created the Florida Disaster Supplier
2 Program Committee. The committee shall be composed of the
3 county emergency operations directors from the nine most
4 populous counties in the state or their designees. The
5 committee shall be charged with the responsibility of
6 establishing the Florida Disaster Supplier Program.
7 (b) The members of the committee shall elect a chair
8 and a vice chair from among their membership. The chair shall
9 preside at all meetings of the committee.
10 (c) The committee shall meet at the call of the chair
11 or at the request of a majority of its membership.
12 (d) Members shall serve for the duration of the
13 existence of the committee. A vacancy on the committee shall
14 be filled by the chair for the remainder of the unexpired
15 term.
16 (e) Members of the committee shall serve without
17 compensation but shall be entitled to per diem and travel
18 expenses as provided in s. 112.061 while engaged in the
19 performance of their duties.
20 (4) DUTIES AND RESPONSIBILITIES.--Duties and
21 responsibilities of the committee shall include, but not be
22 limited to, recommending to the division:
23 (a) State disaster preparedness criteria necessary to
24 the implementation of the program.
25 (b) A system of certification for disaster suppliers
26 in the following categories:
27 1. Medicine.
28 2. Gasoline.
29 3. Ice.
30 (c) The assessment of an annual license fee for
31 businesses seeking to obtain certification as a state disaster

1 supplier under the program and caps and guidelines for such
2 license fee.
3 (d) A uniform state logo that bears the names of the
4 respective counties participating in the program.
5 (5) USE OF LICENSE FEES.--License fees recommended by
6 the committee must be apportioned with 90 percent of the
7 license fees to be used by the participating counties for
8 emergency disaster preparedness and 10 percent of the license
9 fees to be deposited in the State Treasury into the General
10 Revenue Fund.
11 (6) REPORT.--The committee shall submit a report on
12 the development and implementation of the program to the
13 Governor, the Speaker of the House of Representatives, and the
14 President of the Senate no later than July 1, 2009. The report
15 shall include recommendations for any needed legislation with
16 respect to the provision of supplies within the state during a
17 state of emergency or natural or manmade disaster or
18 catastrophe.
19 (7) TERMINATION.--The committee shall terminate on
20 July 1, 2009.
21 Section 2. This act shall take effect July 1, 2006.
