13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 252.63, Florida Statutes, is
16 created to read:
17 252.63 Florida Disaster Supplier Program Council.--
18 (1) The Florida Disaster Supplier Program Council is
19 created under the Department of Community Affairs.
20 (a) The council shall consist of seven members,
21 comprised of one county emergency management director from
22 each of the seven Division of Emergency Management operational
23 regions, as designated by the Florida Emergency Preparedness
24 Association. The council shall make recommendations for a
25 voluntary local program to be established as the Florida
26 Disaster Supplier Program. The intent of the Florida Disaster
27 Supplier Program is to establish statewide oversight of the
28 availability and provision of necessary supplies prior to,
29 during, and following a state of emergency or natural or
30 manmade disaster or catastrophe. The disaster supplier program
31 shall allow businesses to voluntarily participate in the

1 program and provide for the sale of emergency-use supplies and
2 services before, during, and following an emergency or
3 disaster under the conditions set forth in this section. The
4 Disaster Supplier Program Council shall recommend guidelines
5 and administration standards for participating counties.
6 Participation in the program shall be at the option of each
7 county governing body within the state. Each county choosing
8 to participate in the program shall be responsible for
9 administering the program within that county.
10 (b) The Florida Disaster Supplier Program shall be
11 designed so as not to interfere with the normal and ongoing
12 commerce occurring in any political subdivision of the state.
13 The intent of the program is to assist in the rapid recovery
14 of an area affected by a manmade or natural disaster and to
15 stimulate local economies immediately in a postdisaster
16 recovery. Additionally, this program shall be designed to
17 provide the public with alternative access to certain
18 commodities as recommended by the council.
19 (c) The members of the council shall elect a chair and
20 a vice chair from among their membership. The chair shall
21 preside at all meetings of the council.
22 (d) The council shall meet at the call of the chair or
23 at the request of a majority of its membership.
24 (e) Members shall serve for the duration of the
25 existence of the council. A vacancy on the council shall be
26 filled by the chair according to the original membership
27 stipulations until the council is terminated.
28 (f) Members of the council shall serve without
29 compensation, but are entitled to per diem and travel expenses
30 as provided in s. 112.061 while engaged in the performance of
31 their official duties.

1 (2) Duties and responsibilities of the council shall
2 include, but are not limited to, recommending to the division:
3 (a) State disaster preparedness criteria necessary for
4 implementation of the program.
5 (b) Methodology for granting access to participating
6 business for means of operating, supplying, and staffing of
7 their business units in times of emergency when and where
8 feasible under the existing emergency conditions.
9 (c) A statewide system of certification for disaster
10 suppliers in the following categories: pharmaceutical, food
11 and water, building supplies, ice, and other suppliers as may
12 be necessary.
13 (d) The possible assessment of an annual program
14 membership fee for businesses voluntarily seeking to obtain
15 certification as a state disaster supplier under the
16 established program guidelines. The determination of the
17 applicability or nonapplicability of any fees shall include
18 county surveys and input from business, industry, and state
19 agencies enumerated to establish the requirements for any
20 necessary fees. Any recommendation concerning fees shall be
21 contained in the report required in subsection (6).
22 (e) A State Emergency Response Team (SERT) logo that
23 bears the name of the state and the type of supplies being
24 provided by the supplier, to be displayed by businesses
25 participating in the voluntary program.
26 (3) Upon the recommendations of the council,
27 certification of a business requesting to participate in the
28 program shall be conducted through county emergency managers
29 or designees as set forth by the county's elected governing
30 body. Participating counties shall use the certification

1 standards developed by the Florida Disaster Supplier Program
2 Council.
3 (4) If applicable, methods for collecting program
4 membership fees shall be determined by the council. If
5 applicable, program membership fees collected shall be used in
6 whole or in part to recover the administrative cost of the
7 program and as recommended by the council.
8 (5) If applicable, program membership fees shall be
9 used by the participating counties and state agencies as
10 determined by the recommendations of the council and provided
11 by law.
12 (6) The council shall submit a report on the
13 development and implementation of the program to the Governor,
14 the President of the Senate, and the Speaker of the House of
15 Representatives no later than February 1, 2007. The report
16 must include recommendations for any needed legislation and
17 recommended fees with respect to the program and its effect on
18 the provision of supplies within the state during a state of
19 emergency or natural or manmade disaster or catastrophe.
20 (7) The council shall terminate on July 1, 2008.
21 Section 2. This act shall take effect July 1, 2006.

COMMITTEE SUBSTITUTE FOR

4 This committee substitute creates the Florida Disaster
Supplier Program Council under the Department of Community
5 Affairs. This committee substitute specifies the membership of
the council as one county emergency management director from
6 each of the seven Division of Emergency Management operational
regions. The council is charged with making recommendations
7 for the establishment of the Florida Disaster Supply Program.
8 The duties and responsibilities of the council shall include,
but not be limited to, recommending to the Division of
9 Emergency Management:
10 State disaster preparedness criteria necessary to
implement the program

A methodology for participating businesses to operate,
12 supply, and staff their business units during times of
limited access
13
A statewide disaster supplier certification system for
14 supplies of pharmaceuticals, food and water, building
supplies, ice, and others as may be necessary
15
The possible assessment of an annual program membership
16 fee for participating businesses. The council shall make
a recommendation for the necessity of any fees based on
17 county surveys and input from business, industry, and
state agencies. Such recommendation shall be included in
18 a required report
19 A State Emergency Response Team (SERT) logo to be
displayed by participating businesses

This committee substitute provides that contingent upon
21 recommendation of procedures and standards by the council, a
participating business will be certified through county
22 emergency managers or their designees as set forth by the
county's elected governing body.

This committee substitute requires the council to determine
24 the need for program membership fees to provide for program
administrative costs. Recommendations for the need for fees,
25 methods of collection, and uses of such fees shall be made in
a required report. The report shall be made to the Governor
26 and the Legislature's presiding officers no later than
February 1, 2007 and must also include recommendations
27 concerning the program's effectiveness during a state of
emergency or disaster.

29 July 1, 2008.
