1 A bill to be entitled
2 An act relating to the school health services
3 program; amending s. 381.0056, F.S.; defining
4 the term "school-based health center" for
5 purposes of the School Health Services Act;
6 providing that such a center is a health care
7 entity acting as an instrumentality of the
8 state for purposes of certain limitations on
9 liability; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsection (3) of section 381.0056, Florida
14 Statutes, is amended to read:
15 381.0056 School health services program.--
16 (3) When used in or for purposes of this section:
17 (a) "Emergency health needs" means onsite management
18 and aid for illness or injury pending the student's return to
19 the classroom or release to a parent, guardian, designated
20 friend, or designated health care provider.
21 (b) "Entity" or "health care entity" means a unit of
22 local government or a political subdivision of the state; a
23 hospital licensed under chapter 395; a health maintenance
24 organization certified under chapter 641; a health insurer
25 authorized under the Florida Insurance Code; a community
26 health center; a migrant health center; a federally qualified
27 health center; an organization that meets the requirements for
28 nonprofit status under s. 501(c)(3) of the Internal Revenue
29 Code; a private industry or business; a school-based health
30 center; or a philanthropic foundation that agrees to
31 participate in a public-private partnership with a county

1 health department, local school district, or school in the
2 delivery of school health services, and agrees to the terms
3 and conditions for the delivery of such services as required
4 by this section and as documented in the local school health
5 services plan.
6 (c) "Invasive screening" means any screening procedure
7 in which the skin or any body orifice is penetrated.
8 (d) "Physical examination" means a thorough evaluation
9 of the health status of an individual.
10 (e) "School-based health center" means an organization
11 that, at a minimum:
12 1. Provides at least 25 hours per week of primary care
13 services to adolescents or other school-age children in
14 accordance with state law for the majority of the year.
15 2. Primarily provides services onsite at the school,
16 but may also offer linkages and referrals to primary care
17 providers if confidentiality is maintained.
18 3. Provides comprehensive services that include, but
19 are not limited to:
20 a. Acute management and ongoing monitoring of chronic
21 conditions, such as asthma, diabetes, and seizure disorder, in
22 conjunction with a student's regular doctor.
23 b. Well-child or adolescent examinations consisting of
24 a comprehensive health history, including an assessment of
25 high-risk behavior for adolescents, complete physical
26 assessment, screening procedures, and anticipatory guidance
27 appropriate to age.
28 c. Immunizations.
29 d. Diagnosis and treatment of acute illnesses and
30 injuries.
31 e. Basic diagnostic laboratory tests.

1 f. Prescriptions or dispensing of commonly used
2 medications for identified health conditions, in accordance
3 with medical practice and pharmacy practice statutes.
4 g. Individual health education and anticipatory
5 guidance for students and parents.
6 4. Provides comprehensive services that may include,
7 but need not be limited to:
8 a. Age-appropriate reproductive health services,
9 including health education; pelvic examinations; diagnosis and
10 treatment of sexually transmitted diseases; testing and
11 counseling for human immunodeficiency virus (HIV) or acquired
12 immune deficiency syndrome (AIDS); and prescribing,
13 dispensing, or referring for birth control, including condoms.
14 b. Basic mental health services, including assessment;
15 individual, group, and family counseling; consultation with
16 school administrators, parents, teachers, and students; and
17 crisis intervention.
18 5. Maintains health records in a manner that is
19 current, detailed, confidential, organized, and permits
20 effective student care and quality review.
21 6. Does not deny access to health care services to
22 students based upon insurance status or ability to pay, or
23 discriminate with regard to race or ethnicity, religion,
24 national origin, age, disability, gender, or sexual
25 orientation.
26 (f)(e) "School health services plan" means the
27 document that describes the services to be provided, the
28 responsibility for provision of the services, the anticipated
29 expenditures to provide the services, and evidence of
30 cooperative planning by local school districts and county
31 health departments.

1 (g)(f) "Screening" means presumptive identification of
2 unknown or unrecognized diseases or defects by the application
3 of tests that can be given with ease and rapidity to
4 apparently healthy persons.
5 Section 2. This act shall take effect upon becoming a
6 law.
