  1                      A bill to be entitled

  2         An act relating to hunter safety; amending s.

  3         372.5717, F.S.; providing for the Fish and

  4         Wildlife Conservation Commission to issue a

  5         license authorizing a person who is otherwise

  6         unqualified to engage in certain hunting

  7         activities while under supervision; providing

  8         certain limitations on issuing such a license;

  9         exempting a person issued a license authorizing

10         supervised hunting from the requirement to have

11         completed a hunter safety course; revising the

12         required hours of instruction for the hunter

13         safety course; providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  Subsections (2), (3), and (6) of section

18  372.5717, Florida Statutes, are amended to read:

19         372.5717  Hunter safety course; requirements;

20  penalty.--

21         (2)(a)  Except as provided in paragraph (b), a person

22  born on or after June 1, 1975, may not be issued a license to

23  take wild animal life with the use of a firearm, gun, bow, or

24  crossbow in this state without having first successfully

25  completed a hunter safety course as provided in this section,

26  and without having in his or her personal possession a hunter

27  safety certification card, as provided in this section.

28         (b)  The Fish and Wildlife Conservation Commission may

29  issue a license authorizing a person born on or after June 1,

30  1975, who has not successfully completed a hunter safety

31  course to hunt under supervision. A license authorizing

 1  supervised hunting shall be valid for no longer than 1 year

 2  and may not be issued more than once to any one individual. A

 3  person issued a license authorizing supervised hunting may

 4  take wild animal life only with the use of a firearm, gun,

 5  bow, or crossbow while under the supervision and in the

 6  physical presence of a person 21 years of age or older who has

 7  successfully completed a hunter safety course as provided in

 8  this section or who is not required under this section to

 9  complete such a course.

10         (3)  The Fish and Wildlife Conservation Commission

11  shall institute and coordinate a statewide hunter safety

12  course that which must be offered in every county and consist

13  of not less than 12 hours nor more than 16 hours of

14  instruction, including, but not limited to, instruction in the

15  competent and safe handling of firearms, conservation, and

16  hunting ethics.

17         (6)  All persons subject to the requirements of

18  subsection (2) must have in their personal possession, proof

19  of compliance with this section, while taking or attempting to

20  take wildlife with the use of a firearm, gun, bow, or crossbow

21  and must, unless the requirement to complete a hunter safety

22  course is deferred pursuant to this section, display a valid

23  hunter safety certification card to county tax collectors or

24  their subagents in order to purchase a Florida hunting

25  license. After the issuance of such a license, the license

26  itself shall serve as proof of compliance with this section.

27  A holder of a lifetime license whose license does not indicate

28  on the face of the license that a hunter safety course has

29  been completed must have in his or her personal possession a

30  hunter safety certification card, as provided by this section,

 1  while attempting to take wild animal life with the use of a

 2  firearm, gun, bow, or crossbow.

 3         Section 2.  This act shall take effect October 1, 2006.

 6                          SENATE SUMMARY

 7    Authorizes the Fish and Wildlife Conservation Commission
      to issue, under certain conditions, a license allowing a
 8    person to engage in certain hunting activities while
      under supervision.  Exempts a person issued such a
 9    license from certain requirements regarding completion of
      a hunter safety course.
