  1                      A bill to be entitled

  2         An act relating to the Department of

  3         Corrections; amending s. 944.474, F.S.;

  4         clarifying provisions prohibiting the illegal

  5         use of controlled substances by department

  6         employees; authorizing the department to

  7         develop a program for the random drug testing

  8         of employees upon a reasonable suspicion;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsection (2) of section 944.474, Florida

14  Statutes, is amended to read:

15         944.474  Legislative intent; employee wellness program;

16  drug and alcohol testing.--

17         (2)  Under no circumstances shall employees of the

18  department test positive for illegal use of controlled

19  substances as defined by s. 893.03. An employee of the

20  department may not be under the influence of alcohol while on

21  duty. In order to ensure that these prohibitions are adhered

22  to by all employees of the department and notwithstanding s.

23  112.0455, the department may develop a program for the random

24  drug testing of all employees upon reasonable suspicion. The

25  department may randomly evaluate employees for the

26  contemporaneous use or influence of alcohol through the use of

27  alcohol tests and observation methods.

28         Section 2.  This act shall take effect July 1, 2006.
