16 lines

18 and insert:
19 (3) Notwithstanding any other law, a physician
20 licensed under chapter 458 or chapter 459 shall report
21 immediately to the department in writing the full name, date
22 of birth, and address of each patient older than 15 years of
23 age whom the physician has diagnosed as having a mental or
24 physical disability as described in subsection (4). There
25 shall be no monetary liability on the part of, and no cause of
26 action for damages shall arise against, any physician for any
27 action taken without intentional fraud, or for the failure to
28 take any action, in carrying out the provisions of this
29 paragraph.
30 (4) The Board of Medicine as established in chapter
31 458 and the Board of Osteopathic Medicine as established in

1 chapter 459 shall establish by rule on or before January 1,
2 2007, those mental or physical disabilities as required under
3 subsection (3) which could effect a patient's driving ability
4 for which a physician licensed under chapter 458 or chapter
5 459 shall report to the department.
6 (5)(3) The reports authorized by this section shall be
7 confidential and exempt from the provisions of s. 119.07(1)
8 and shall be used solely for the purpose of determining the
9 qualifications of any person to operate a motor vehicle on the
10 highways of this state. No civil or criminal action may be
11 brought against any physician, person, or agency who provides
12 the information required herein.
13 (6)(4) No report forwarded under the provisions of
14 this section shall be used as evidence in any civil or
15 criminal trial or in any court proceeding.
16 Section 3. Subsection (2) of section 322.18, Florida
17 Statutes, is amended to read:
18 (2) Each applicant who is entitled to the issuance of
19 a driver's license, as provided in this section, shall be
20 issued a driver's license, as follows:
21 (a) An applicant applying for an original issuance
22 shall be issued a driver's license which expires at midnight
23 on the licensee's birthday which next occurs on or after the
24 sixth anniversary of the date of issue.
25 (b) An applicant applying for a renewal issuance or
26 renewal extension shall be issued a driver's license or
27 renewal extension sticker which expires at midnight on the
28 licensee's birthday which next occurs 4 years after the month
29 of expiration of the license being renewed, except that a
30 driver whose driving record reflects no convictions for the
31 preceding 3 years shall be issued a driver's license or

1 renewal extension sticker which expires at midnight on the
2 licensee's birthday which next occurs 6 years after the month
3 of expiration of the license being renewed.
4 (c) Notwithstanding any other provision of this
5 chapter, if an applicant establishes his or her identity for a
6 driver's license using a document authorized under s.
7 322.08(2)(c)5., the driver's license shall expire in
8 accordance with paragraph (b). After an initial showing of
9 such documentation, he or she is exempted from having to renew
10 or obtain a duplicate in person.
11 (d) Notwithstanding any other provision of this
12 chapter, if an applicant establishes his or her identity for a
13 driver's license using a document authorized in s.
14 322.08(2)(c)6. or 7., the driver's license shall expire 2
15 years after the date of issuance or upon the expiration date
16 cited on the United States Department of Homeland Security
17 documents, whichever date first occurs.
18 (e) Notwithstanding any other provision of this
19 chapter, an applicant applying for an original or renewal
20 issuance of a commercial driver's license as defined in s.
21 322.01(7), with a hazardous-materials endorsement, pursuant to
22 s. 322.57(1)(e), shall be issued a driver's license that
23 expires at midnight on the licensee's birthday that next
24 occurs 4 years after the month of expiration of the license
25 being issued or renewed.
26 (f) Notwithstanding any other provision of this
27 chapter, the driver's license of any person expires at
28 midnight on the licensee's 80th birthday. A license issued to
29 a person after that person is 80 years of age shall expire at
30 midnight on the licensee's birthday that next occurs on or
31 after the fourth/anniversary of the date of issue.
