11  The Committee on Regulated Industries (Posey) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 18, between lines 20 and 21,
16  
17  insert:  
18         Section 6.  Present subsections (8) through (27) of
19  section 633.021, Florida Statutes, are redesignated as
20  subsections (9) through (28), respectively, and a new
21  subsection (8) is added to that section, to read:
22         633.021  Definitions.--As used in this chapter:
23         (8)  A "fire hydrant" is a connection to a water main,
24  elevated water tank, or other source of water for the purpose
25  of supplying water to a fire hose or other fire protection
26  apparatus for fire-suppression operations.
27         Section 7.  Section 633.082, Florida Statutes, is
28  amended to read:
29         633.082  Inspection of fire control systems, fire
30  hydrants, and fire protection systems.--
31         (1)  The State Fire Marshal shall have the right to

 1  inspect any fire control system during and after construction
 2  to determine that such system meets the standards set forth in
 3  the laws and rules of the state.
 4         (2)  Fire hydrants and fire protection systems
 5  installed in public and private properties, except one-family
 6  or two-family dwellings, in this state shall be inspected
 7  following procedures established in the nationally recognized
 8  inspection, testing, and maintenance standards NFPA-24 and
 9  standard NFPA-25 as set forth in the edition adopted by the
10  State Fire Marshal. Quarterly, annual, 3-year, and 5-year
11  inspections consistent with the contractual provisions with
12  the owner shall be conducted by the certificateholder or
13  permittees employed by the certificateholder pursuant to s.
14  633.521.
15         (3)  The inspecting contractor shall provide to the
16  building owner or hydrant owner and the local authority having
17  jurisdiction a copy of the applicable inspection report
18  established under this chapter s. 633.071(3). The maintenance
19  of fire hydrant and fire protection systems as well as
20  corrective actions on deficient systems is the responsibility
21  of the owner of the system or hydrant. This section does not
22  prohibit governmental entities from inspecting and enforcing
23  firesafety codes.
24         (4)  At least once each year, each fire hydrant shall
25  be opened fully and the water allowed to flow until all
26  foreign materials have cleared the hydrant. The flow shall be
27  maintained for not less than 1 minute.
28         (5)  If a fire hydrant is made nonfunctional by the
29  closing of a water supply valve, the valve must immediately be
30  tagged with a red tag that is boldly marked "nonfunctional"
31  and the local fire authority notified that the hydrant is

 1  nonfunctional.
 2         Section 8.  Section 633.5391, Florida Statutes, is
 3  repealed.

10         On page 1, line 21, after the semicolon,

12  insert:
13         amending s. 633.021, F.S.; defining the term
14         "fire hydrant" for the purpose of the Florida
15         Fire Prevention Code; amending s. 633.082,
16         F.S.; providing for the inspection of fire
17         hydrants by the State Fire Marshal; requiring
18         that each fire hydrant be opened fully at least
19         once each year to clear foreign materials in
20         the system; providing that a fire hydrant made
21         nonfunctional by the closing of a water supply
22         valve must immediately be tagged with a red tag
23         that is boldly marked "nonfunctional";
24         repealing s. 633.5391, F.S., relating to
25         backflow prevention assembly inspection;
