1 A bill to be entitled
2 An act relating to the Wekiva Onsite Disposal
3 System Compliance Grant Program; creating the
4 program in the Department of Health; providing
5 purposes; authorizing certain property owners
6 in certain areas of the Wekiva basin to apply
7 for grants for certain purposes; providing
8 grant limitations; providing for annual
9 adjustments of the amount of the grants;
10 providing for the grant as a rebate of costs
11 incurred; requiring documentation of costs;
12 requiring the department to adopt rules to
13 administer the grant program; providing an
14 appropriation; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Wekiva Onsite Disposal System Compliance
19 Grant Program.--
20 (1) The Wekiva Onsite Disposal System Compliance Grant
21 Program is established in the Department of Health, to be
22 administered by the department. The purpose of the program is
23 to provide grants to low-income property owners in the Wekiva
24 Study Area or the Wekiva River Protection Area using onsite
25 disposal systems to assist the property owner in complying
26 with rules for onsite disposal systems developed by the
27 Department of Health, the Department of Environmental
28 Protection, or the St. Johns River Water Management District
29 to enforce compliance with onsite disposal system standards.
30 (2) Any property owner in the Wekiva Study Area or the
31 Wekiva River Protection Area having an income less than or

1 equal to 200 percent of the federal poverty level who is
2 required by rule of the Department of Health, the Department
3 of Environmental Protection, or the St. Johns River Water
4 Management District to construct, reconstruct, alter, repair,
5 or modify any new or existing onsite disposal system on such
6 property may apply to the Department of Health for a grant to
7 assist the owner with the cost of compliance.
8 (3) The amount of the grant is limited to $10,000 per
9 property and shall be increased each calendar year by the
10 change in the annual average of the "materials and components
11 for construction" series of the producer price index, as
12 calculated and published by the United States Department of
13 Labor, Bureau of Statistics, from the previous calendar year.
14 (4) The grant shall be in the form of a rebate to the
15 property owner for costs incurred in complying with
16 requirements for onsite disposal systems. The property owner
17 shall provide to the Department of Health in the application
18 for a grant documentation of costs incurred in complying with
19 requirements for such systems.
20 (5) The Department of Health shall adopt rules
21 providing forms, procedures, and requirements for applying for
22 and disbursing grants under this section and for documenting
23 compliance costs incurred.
24 Section 2. The sum of $ is appropriated from the
25 General Revenue Fund to the Department of Health, of which
26 $ is to the department to administer the Wekiva Onsite
27 Disposal System Compliance Grant Program and $ is to
28 provide grants to applicants under the program.
29 Section 3. This act shall take effect July 1, 2006.
