1 A bill to be entitled
2 An act relating to public benefits; amending s.
3 110.123, F.S., relating to the state group
4 insurance program; prohibiting funding for
5 benefits granted under the program from being
6 used to provide benefits for any individuals
7 other than enrollees and the spouses and
8 dependent children of enrollees; amending s.
9 1001.64, F.S.; prohibiting community college
10 boards of trustees from establishing benefits
11 programs that use state funding to provide
12 benefits for any individuals other than
13 enrollees and the spouses and dependent
14 children of enrollees; amending s. 1001.74,
15 F.S.; prohibiting university boards of trustees
16 from establishing benefits programs that use
17 state funding to provide benefits for any
18 individuals other than enrollees and the
19 spouses and dependent children of enrollees;
20 providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:
23
24 Section 1. Subsection (13) is added to section
25 110.123, Florida Statutes, to read:
26 110.123 State group insurance program.--
27 (13) CERTAIN BENEFITS PROHIBITED.--No state funding
28 for benefits granted under this section shall be used to
29 provide benefits for any individuals other than enrollees and
30 the spouses and dependent children of enrollees.

1 Section 2. Subsection (18) of section 1001.64, Florida
2 Statutes, is amended to read:
3 1001.64 Community college boards of trustees; powers
4 and duties.--
5 (18) Each board of trustees shall establish the
6 personnel program for all employees of the community college,
7 including the president, pursuant to the provisions of chapter
8 1012 and rules and guidelines of the State Board of Education,
9 including: compensation and other conditions of employment;
10 recruitment and selection; nonreappointment; standards for
11 performance and conduct; evaluation; benefits and hours of
12 work; leave policies; recognition; inventions and work
13 products; travel; learning opportunities; exchange programs;
14 academic freedom and responsibility; promotion; assignment;
15 demotion; transfer; ethical obligations and conflict of
16 interest; restrictive covenants; disciplinary actions;
17 complaints; appeals and grievance procedures; and separation
18 and termination from employment. The boards of trustees are
19 prohibited from establishing benefits programs that use state
20 funding to provide benefits for any individuals other than
21 enrollees and the spouses and dependent children of enrollees.
22 Section 3. Subsection (19) of section 1001.74, Florida
23 Statutes, is amended to read:
24 1001.74 Powers and duties of university boards of
25 trustees.--
26 (19) Each board of trustees shall establish the
27 personnel program for all employees of the university,
28 including the president, pursuant to the provisions of chapter
29 1012 and, in accordance with rules and guidelines of the State
30 Board of Education, including: compensation and other
31 conditions of employment, recruitment and selection,

1 nonreappointment, standards for performance and conduct,
2 evaluation, benefits and hours of work, leave policies,
3 recognition and awards, inventions and works, travel, learning
4 opportunities, exchange programs, academic freedom and
5 responsibility, promotion, assignment, demotion, transfer,
6 tenure and permanent status, ethical obligations and conflicts
7 of interest, restrictive covenants, disciplinary actions,
8 complaints, appeals and grievance procedures, and separation
9 and termination from employment. The boards of trustees are
10 prohibited from establishing benefits programs that use state
11 funding to provide benefits for any individuals other than
12 enrollees and the spouses and dependent children of enrollees.
13 The Department of Management Services shall retain authority
14 over state university employees for programs established in
15 ss. 110.123, 110.161, 110.1232, 110.1234, and 110.1238 and in
16 chapters 121, 122, and 238.
17 Section 4. This act shall take effect July 1, 2006.
