1 A bill to be entitled
2 An act relating to uses of the district school
3 tax; amending s. 1011.71, F.S.; including
4 health, property, and casualty insurance costs
5 as authorized uses of school district millage;
6 authorizing school districts meeting certain
7 class size requirements to use revenues
8 generated by the district school tax for
9 specified purposes; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Paragraph (j) is added to subsection (2)
15 and paragraph (e) is added to subsection (5) of section
16 1011.71, Florida Statutes, to read:
17 1011.71 District school tax.--
18 (2) In addition to the maximum millage levy as
19 provided in subsection (1), each school board may levy not
20 more than 2 mills against the taxable value for school
21 purposes to fund:
22 (j) Health, property, and casualty insurance costs of
23 the school district.

25 Violations of these expenditure provisions shall result in an
26 equal dollar reduction in the Florida Education Finance
27 Program (FEFP) funds for the violating district in the fiscal
28 year following the audit citation.

30 (e) Notwithstanding any other provision of this
31 subsection, school districts that have met the class size

1 requirements of s. 1003.03 may use the revenue generated by
2 the millage levy authorized by subsection (2) for the purposes
3 delineated in subsection (2).

5 A district that violates these expenditure restrictions shall
6 have an equal dollar reduction in funds appropriated to the
7 district under s. 1011.62 in the fiscal year following the
8 audit citation. The expenditure restrictions do not apply to
9 any school district that certifies to the Commissioner of
10 Education that all of the district's instructional space needs
11 for the next 5 years can be met from capital outlay sources
12 that the district reasonably expects to receive during the
13 next 5 years or from alternative scheduling or construction,
14 leasing, rezoning, or technological methodologies that exhibit
15 sound management.
16 Section 2. This act shall take effect July 1, 2006.
