11 The Committee on Criminal Justice (King) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 Delete everything after the enacting clause
16
17 and insert:
18 Section 1. Section 794.075, Florida Statutes, is
19 created to read:
20 794.075 Sexual predators; erectile dysfunction
21 drugs.--
22 (1) A person may not possess a prescription drug, as
23 defined in s. 499.003(25), for the purpose of treating
24 erectile dysfunction if the person is designated as a sexual
25 predator under s. 775.21.
26 (2) A person who violates subsection (1) for the first
27 time commits a misdemeanor of the second degree, punishable as
28 provided in s. 775.082 or s. 775.083. A person who violates
29 subsection (1) a second or subsequent time commits a
30 misdemeanor of the first degree, punishable as provided in s.
31 775.082 or s. 775.083.

1 Section 2. This act shall take effect October 1, 2006.

11 s. 794.075, F.S.; prohibiting a sexual predator

13 purpose of treating erectile dysfunction;
14 providing criminal penalties; providing an
15 effective date.
