  1                      A bill to be entitled

  2         An act relating to sexual predators; creating

  3         s. 794.075, F.S.; prohibiting a sexual predator

  4         from possessing prescription drugs for the

  5         purpose of treating erectile dysfunction;

  6         providing criminal penalties; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Section 794.075, Florida Statutes, is

12  created to read:

13         794.075  Sexual predators; erectile dysfunction

14  drugs.--

15         (1)  A person may not possess a prescription drug, as

16  defined in s. 499.003(25), for the purpose of treating

17  erectile dysfunction if the person is designated as a sexual

18  predator under s. 775.21.

19         (2)  A person who violates subsection (1) for the first

20  time commits a misdemeanor of the second degree, punishable as

21  provided in s. 775.082 or s. 775.083. A person who violates

22  subsection (1) a second or subsequent time commits a

23  misdemeanor of the first degree, punishable as provided in s.

24  775.082 or s. 775.083.

25         Section 2.  This act shall take effect October 1, 2006.

30  Prohibits a person who is designated a sexual predator under
