11  Senator Bennett moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 19, between lines 11 and 12,
15  
16  insert:  
17         Section 9.  Section 723.083, Florida Statutes, is
18  amended to read:
19         723.083  Governmental action affecting removal of
20  mobile home owners.--
21         (1)  No agency of municipal, local, county, or state
22  government shall approve any application for rezoning, or take
23  any other official action, which would result in the removal
24  or relocation of mobile home owners residing in a mobile home
25  park without first determining that adequate mobile home parks
26  or other suitable facilities exist for the relocation of the
27  mobile home owners.
28         (2)  Upon a finding that adequate mobile home parks or
29  other suitable facilities exist for the relocation of mobile
30  home owners, and pursuant to the subsequent rezoning or other
31  official action that results in the removal or relocation of

Florida Senate - 2006 SENATOR AMENDMENT Bill No. CS for CS for SB 1858 Barcode 794504 1 mobile home owners, one-fifth of the increase in county or 2 municipal ad valorem property taxes levied, exclusive of any 3 amount from any debt service millage, created as a result of 4 the development of the land previously occupied by the mobile 5 home park must be transferred for a period of 5 years to the 6 the appropriate local housing trust fund for the purpose of 7 providing housing assistance to mobile home owners affected by 8 the removal or relocation of a mobile home park. The amount to 9 be transferred shall be determined annually and shall be that 10 amount equal to one-fifth of 95 percent of the difference 11 between: 12 (a) The amount of county and municipal ad valorem 13 taxes levied each year, exclusive of any amount from any debt 14 service millage, on the parcel or parcels of property formerly 15 occupied by the mobile home park; and 16 (b) The amount of county and municipal ad valorem 17 taxes levied, exclusive of any amount from any debt service 18 millage, on the parcel or parcels of property occupied by the 19 mobile home park in the last year such park operated as a 20 mobile home park. 21 22 The first transfer must be made by January 1 of the second 23 year following the substantial completion of the new 24 development.
