  2         An act relating to pawnbroking; amending s.

  3         539.001, F.S.; providing that local ordinances

  4         may not require the payment of any fee or tax

  5         related to a pawn transaction or purchase

  6         unless authorized under the Florida Pawnbroking

  7         Act; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (20) of section 539.001, Florida

12  Statutes, is amended to read:

13         539.001  The Florida Pawnbroking Act.--

14         (20)  CONFLICTING ORDINANCES.--Any county or

15  municipality may enact ordinances that are in compliance with,

16  but not more restrictive than this section, except that local

17  ordinances shall may not require the payment of any fee or tax

18  related to a pawn transaction or purchase unless authorized in

19  this chapter or restrict hours of operations other than

20  between midnight and 6 a.m. Any ordinance that conflicts with

21  this subsection is void. Nothing in This section does not

22  shall affect the authority of a county or municipality to

23  establish land use controls or require a pawnbroker to obtain

24  a local occupational license.

25         Section 2.  This act shall take effect July 1, 2006.

30  The CS clarifies that a local government shall not require a
    fee or "tax" related to a pawn transaction or "purchase"
31  unless authorized by the Legislature.
