11  Senator Argenziano moved the following amendment:

13         Senate Amendment 
14         On page 6, line 10, through
15            page 7, line 2, delete those lines
16  
17  and insert:  
18         (c)  A local government or water and sewer district
19  responsible for the operation of a centralized sewer system
20  under s. 153.62 may grant a variance to an owner of a
21  performance-based onsite sewage treatment and disposal system
22  permitted by the department as long as the onsite system is
23  functioning properly and satisfying the conditions of the
24  operating permit. Nothing in this paragraph shall be construed
25  to require a local government or water and sewer district to
26  issue a variance under any circumstance. Nothing in this
27  paragraph shall be construed as limiting local government
28  authority to enact ordinances under s. 4, chapter 99-395, Laws
29  of Florida. A local government or water and sewer district
30  located in any of the following areas shall not be required to
31  issue a variance under any circumstance:

 1         1.  An area of critical state concern.
 2         2.  An area that was designated as an area of critical
 3  state concern for at least 20 consecutive years prior to
 4  removal of the designation.
 5         3.  An area in the South Florida Water Management
 6  District west C-11 basin which discharges through the S-9 pump
 7  into the Everglades.
 8         4.  An area designated by the Lake Okeechobee
 9  Protection Act.
