1 A bill to be entitled
2 An act relating to the Department of Community
3 Affairs; amending s. 20.18, F.S.; providing
4 that the Director of the Division of Emergency
5 Management be appointed by the Governor;
6 providing that the division be a separate
7 budget entity, not subject to control by the
8 department; providing for an agreement between
9 the division and department for certain
10 services; prescribing duties of the division;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Paragraph (a) of subsection (2) of section
16 20.18, Florida Statutes, is amended to read:
17 20.18 Department of Community Affairs.--There is
18 created a Department of Community Affairs.
19 (2) The following units of the Department of Community
20 Affairs are established:
21 (a) Division of Emergency Management. The division
22 director shall be appointed by and serve under the oversight
23 of the Governor in carrying out the responsibilities of
24 chapter 252. The division is a separate budget entity and not
25 subject to the control, supervision, or direction of the
26 department in matters involving personnel, purchasing, and
27 budget. The division shall enter into a service agreement with
28 the department for professional, technological, and
29 administrative support services. The division shall
30 collaborate and coordinate with the department on nonemergency
31 response matters, including, but not limited to, disaster

1 recovery programs, grant programs, mitigation programs, and
2 emergency matters related to comprehensive plans.
3 Section 2. This act shall take effect July 1, 2006.

6 SENATE SUMMARY
7 Provides a more autonomous role for the Division of
Emergency Management of the Department of Community
8 Affairs. The division is under the oversight of the
Governor, rather than the department, and will function
9 as a separate budget entity for purposes of personnel,
purchasing, and budget. Provides for the division
10 director to be appointed by the Governor, not the
Secretary of Community Affairs. Provides for a service
11 agreement for support services between the division and
department.
