1 A bill to be entitled
2 An act relating to the Department of Community
3 Affairs; amending s. 20.18, F.S.; providing
4 that the Director of the Division of Emergency
5 Management be designated as agency head of the
6 division; providing for the director to be
7 appointed by the Governor; providing that the
8 division is a separate budget entity, not
9 subject to control by the department; providing
10 for an agreement between the division and
11 department for certain services; prescribing
12 duties of the division; providing an effective
13 date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Paragraph (a) of subsection (2) of section
18 20.18, Florida Statutes, is amended to read:
19 20.18 Department of Community Affairs.--There is
20 created a Department of Community Affairs.
21 (2) The following units of the Department of Community
22 Affairs are established:
23 (a) Division of Emergency Management. The division is
24 a separate budget entity and is not subject to control,
25 supervision, or direction by the Department of Community
26 Affairs in any manner, including, but not limited to,
27 personnel, purchasing, transactions involving personal
28 property, and budgetary matters. The division director shall
29 be appointed by the Governor, shall serve at the pleasure of
30 the Governor, and shall be the agency head of the division for
31 all purposes. The division shall enter into a service

1 agreement with the department for professional, technological,
2 and administrative support services. The division shall
3 collaborate and coordinate with the department on nonemergency
4 response matters, including, but not limited to, disaster
5 recovery programs, grant programs, mitigation programs, and
6 emergency matters related to comprehensive plans.
7 Section 2. This act shall take effect July 1, 2006.

9 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN

12 Establishes the Division of Emergency Management as a separate
agency with an agency head appointed by, and serving at the
13 pleasure of, the Governor.
14 Clearly provides that the division director is the agency head
of the division for all purposes.
