11 The Committee on Judiciary (Clary) recommended the following
12 amendment to amendment (773348):

14 Senate Amendment (with title amendment)
15 On page 9, line 29, through
16 page 10, line 12, delete those lines
17
18 and insert:
19 SECTION 26. Claimant's right to fair compensation.--
20 (a) Article I, Section 26 is created to read
21 "Claimant's right to fair compensation." In any medical
22 liability claim involving a contingency fee, the claimant is
23 entitled to receive no less than 70% of the first $250,000.00
24 in all damages received by the claimant, exclusive of
25 reasonable and customary costs, whether received by judgment,
26 settlement, or otherwise, and regardless of the number of
27 defendants. The claimant is entitled to 90% of all damages in
28 excess of $250,000.00, exclusive of reasonable and customary
29 costs and regardless of the number of defendants. This
30 provision is self-executing and does not require implementing
31 legislation.
