17 BE IT FURTHER RESOLVED that the following statement be
18 placed on the ballot:
19 CONSTITUTIONAL REVISION
20 MULTIPLE ARTICLES
21 REPEAL OF OBSOLETE PROVISIONS; LEGISLATION BY CITIZEN
22 INITIATIVE; PRESERVATION OF CONSTITUTIONAL PROVISIONS AS
23 STATUTES.--Proposing a revision of the State Constitution to
24 correct spelling errors, punctuation errors, and grammatical
25 errors, repeal obsolete provisions, repeal provisions that
26 violate the United States Constitution, and make technical
27 changes; to correct an erroneous filing date in Article XI,
28 section 6(e), which relates to the Taxation and Budget Reform
29 Commission; to authorize legislation by citizen initiative;
30 and to provide for the repeal of certain constitutional
31 provisions and their preservation as statutes. Legislation by

1 citizen initiative and the repeal and preservation of certain
2 constitutional provisions as statutes are described in detail
3 below.
4 ARTICLE III, SECTION 19
5 Legislation by citizen initiative.--Proposing the
6 creation of a new section to the State Constitution to provide
7 for the introduction of proposed legislation by filing with
8 the custodian of state records a petition signed by a
9 specified number of electors, to provide for such proposed
10 legislation to be brought before the Legislature for enactment
11 at the regular session following submission of the petition,
12 to provide for the proposed legislation to be placed on the
13 ballot at a subsequent general election if the Legislature
14 fails to enact the proposed legislation and if a petition
15 signed by a specified number of electors is filed with the
16 custodian of state records, to require that the proposed
17 legislation embrace one subject and matter directly connected
18 therewith, to prohibit the proposal of legislation by
19 initiative which concerns certain subjects, to prohibit the
20 Governor from vetoing legislation proposed by initiative and
21 approved by the electors, to require a three-fourths vote of
22 the Legislature in order to amend or repeal legislation
23 proposed by initiative during the 5 years immediately
24 following enactment and a majority vote of the Legislature
25 thereafter, to require the statewide publication of notice of
26 legislation proposed by initiative during the 10th and 6th
27 week before the election at which the proposed legislation is
28 considered, and to provide for legislation proposed by
29 initiative to take effect on July 1 following the general
30 election at which it is approved by the electors.

1 Preservation of constitutional provisions as
2 statutes.--Proposing to repeal the following provisions from
3 the State Constitution, codify them in the Florida Statutes,
4 and prohibit the Legislature from modifying, repealing, or
5 acting inconsistently with those statutes until January 2,
6 2015, except upon a three-fourths vote of both houses of the
7 Legislature:
8 ARTICLE I, SECTION 26
9 Claimant's right to fair compensation.--This provision
10 provides that an injured claimant who enters into a
11 contingency fee agreement with an attorney in a claim for
12 medical liability is entitled to no less than 70 percent of
13 the first $250,000.00 in all damages received by the claimant,
14 and 90 percent of damages in excess of $250,000.00, exclusive
15 of reasonable and customary costs and regardless of the number
16 of defendants.
17 ARTICLE X, SECTION 21
18 Limiting cruel and inhumane confinement of pigs during
19 pregnancy.--This provision makes it unlawful to confine a pig
20 during pregnancy in a cage, crate or other enclosure, or
21 tether a pregnant pig, on a farm so that the pig is prevented
22 from turning around freely, except for veterinary purposes and
23 during the prebirthing period.
24 ARTICLE X, SECTION 25
25 Patients' right to know about adverse medical
26 incidents.--This provision gives patients the right to review,
27 upon request, records of health care facilities' or providers'
28 adverse medical incidents, including those which could cause
29 injury or death.

31 Prohibition of medical license after repeated medical

1 malpractice.--This provision prohibits medical doctors who
2 have been found to have committed three or more incidents of
3 medical malpractice from being licensed to practice medicine
4 in Florida.
