1 A bill to be entitled
2 An act relating to the racing of animals;
3 amending s. 550.2415, F.S.; requiring the
4 Division of Pari-mutuel Wagering in the
5 Department of Business and Professional
6 Regulation to maintain certain records
7 regarding injuries and the disposition of
8 greyhounds that race in this state; providing
9 guidelines and requirements for injury and
10 disposition report forms; providing for the
11 adoption of rules; providing a penalty;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsection (6) of section 550.2415, Florida
17 Statutes, is amended to read:
18 550.2415 Racing of animals under certain conditions
19 prohibited; penalties; exceptions.--
20 (6)(a) It is the intent of the Legislature that
21 animals that participate in races in this state on which
22 pari-mutuel wagering is conducted and animals that are bred
23 and trained in this state for racing be treated humanely, both
24 on and off racetracks, throughout the lives of the animals.
25 (b) The division shall, by rule, establish the
26 procedures for euthanizing greyhounds. However, a greyhound
27 may not be put to death by any means other than by lethal
28 injection of the drug sodium pentobarbital. A greyhound may
29 not be removed from this state for the purpose of being
30 destroyed.

1 (c) It is a violation of this chapter for an
2 occupational licensee to train a greyhound using live or dead
3 animals. A greyhound may not be taken from this state for the
4 purpose of being trained through the use of live or dead
5 animals.
6 (d) A conviction of cruelty to animals pursuant to s.
7 828.12 involving a racing animal constitutes a violation of
8 this chapter.
9 (e) The division shall maintain accurate records and
10 statistics regarding injuries incurred by greyhounds while
11 racing in this state. The division shall adopt rules requiring
12 the reporting of injuries incurred by greyhounds while racing
13 in this state, including schooling races. The reports must
14 include:
15 1. The greyhound's registered name and right and left
16 ear tattoo numbers.
17 2. The name, business address, and telephone number of
18 the greyhound owner, trainer, and kennel operator.
19 3. The color, weight, and sex of the greyhound.
20 4. The specific type of injury, the cause of the
21 injury, the estimated recovery time, and the location of the
22 injury on the greyhound.
23 5. Where the injury occurred, whether on a racing
24 track or in another area.
25 6. If the injury occurred while the greyhound was
26 racing, the racetrack where the injury occurred; the distance,
27 grade, race, and post position when the injury occurred; and
28 the weather conditions, time, temperature, and track condition
29 at the time of the injury.
30 7. A certification by the racetrack veterinarian that
31 the form is correct.

1 (f) The division shall maintain accurate records and
2 statistics regarding the disposition of greyhounds that
3 participate in racing in this state. The division shall adopt
4 rules requiring the reporting of the disposition of greyhounds
5 that race in this state, including schooling races. As used in
6 the reporting requirement, the term "disposition" means death,
7 transfer to another jurisdiction, retirement, adoption, sale,
8 or donation for medical research or another purpose. The
9 reports must include:
10 1. The greyhound's registered name and right and left
11 ear tattoo numbers; the name, business address, and telephone
12 number of the greyhound owner, trainer, and kennel operator;
13 and the name and address of the race track where the greyhound
14 last raced prior to disposition.
15 2. If the greyhound was transferred to another track,
16 the name and address of the track that received the greyhound
17 and the name, business address, telephone number, and driver's
18 license number and state of issuance of the person who
19 received the greyhound on behalf of that track.
20 3. If the greyhound was retired for breeding, the name
21 and address of the facility that received the greyhound and
22 the name, business address, telephone number, and driver's
23 license number and state of issuance of the person who
24 received the greyhound on behalf of that facility.
25 4. If the greyhound was adopted or placed for
26 adoption, the name and address of the person who received the
27 greyhound and, if applicable, the name, business address,
28 telephone number, and driver's license number and state of
29 issuance of the person who received the greyhound on behalf of
30 the adoption facility.

1 5. If the greyhound was euthanized, the name, address,
2 professional title, professional affiliation of the person
3 performing the euthanasia, method of euthanasia, and reason
4 the greyhound was euthanized rather than adopted.
5 6. If the greyhound was sold or donated, the name of
6 the person to whom the greyhound was sold or donated and, if
7 donated, the name, business address, telephone number, and
8 driver's license number and state of issuance of the person
9 who received the greyhound on behalf of the donee.
10 7. If the disposition of the greyhound does not fit
11 into any of the categories specified in subparagraphs 1.-6.,
12 the name of the person to whom the greyhound was transferred
13 and the name, business address, telephone number, and driver's
14 license number and state of issuance of the person who
15 received the greyhound.
16 8. Certification by the owner, trainer, and kennel
17 operator that the disposition forms are correct.
18 (g) The division shall maintain injury and disposition
19 records for 7 years.
20 (h) In addition to other penalties imposed by law, a
21 person who knowingly makes a false statement on an injury or
22 disposition form on a second or subsequent occasion commits a
23 felony of the third degree, punishable as provided in s.
24 775.082, s. 775.083, or s. 775.084.
25 Section 2. This act shall take effect July 1, 2006.
