  1                      A bill to be entitled

  2         An act relating to bid protest standards;

  3         amending s. 24.109, F.S.; providing that the

  4         administrative law judge in a

  5         competitive-procurement protest may not conduct

  6         a de novo proceeding; requiring an

  7         administrative law judge in a

  8         competitive-procurement protest to review the

  9         intended agency action in order to make certain

10         determinations; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Present paragraph (b) of subsection (2) of

15  section 24.109, Florida Statutes, is redesignated as paragraph

16  (c), and a new paragraph (b) is added to that subsection, to

17  read:

18         24.109  Administrative procedure.--

19         (2)  The provisions of s. 120.57(3) apply to the

20  department's contracting process, except that:

21         (b)  In a competitive-procurement protest, including

22  the rejection of all bids, proposals, or replies, the

23  administrative law judge may not conduct a de novo proceeding

24  but shall review the intended agency action to determine if

25  the action is illegal, arbitrary, dishonest, or fraudulent.

26         Section 2.  This act shall take effect July 1, 2006.
