  1                      A bill to be entitled

  2         An act relating to voyeurism; amending s.

  3         810.14, F.S.; revising the elements of the

  4         offense of voyeurism in order to eliminate acts

  5         of photographing, filming, videotaping, or

  6         recording, which are made a crime under the

  7         offense of video voyeurism; providing that a

  8         person commits the offense of voyeurism when he

  9         or she secretly observes another person when

10         the other person is in a location that provides

11         a reasonable expectation of privacy; providing

12         an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Section 810.14, Florida Statutes, is

17  amended to read:

18         810.14  Voyeurism prohibited; penalties.--

19         (1)  A person commits the offense of voyeurism when he

20  or she, with lewd, lascivious, or indecent intent, secretly

21  observes, photographs, films, videotapes, or records another

22  person when the such other person is located in a dwelling,

23  structure, or conveyance and such location provides a

24  reasonable expectation of privacy.

25         (2)  A person who violates this section commits a

26  misdemeanor of the first degree for the first violation,

27  punishable as provided in s. 775.082 or s. 775.083.

28         (3)  A person who violates this section and who has

29  been previously convicted or adjudicated delinquent two or

30  more times of any violation of this section commits a felony

 1  of the third degree, punishable as provided in s. 775.082, s.

 2  775.083, or s. 775.084.

 3         (4)  For purposes of this section, a person has been

 4  previously convicted or adjudicated delinquent of a violation

 5  of this section if the violation resulted in a conviction

 6  sentenced separately, or an adjudication of delinquency

 7  entered separately, prior to the current offense.

 8         Section 2.  This act shall take effect July 1, 2006.

11                          SENATE SUMMARY

12    Revises the elements of the offense of voyeurism in order
      to eliminate acts of photographing, filming, videotaping,
13    or recording, which are made a crime under the offense of
      video voyeurism. Provides that a person commits the
14    offense of voyeurism when he or she secretly observes
      another person when the other person is in a location
