11  The Committee on Banking and Insurance (Garcia) recommended
12  the following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 55, between lines 3 and 4,
16  
17  insert:  
18         19.  The corporation shall, directly or through the
19  market assistance plan, make information from confidential
20  underwriting files of policyholders available only to licensed
21  general lines agents who register with the corporation to
22  receive such information according to the following
23  procedures:
24         a.  By October 1, 2006, the corporation shall provide
25  policyholders the opportunity to request in writing, within 45
26  days after the notification is sent, that information from
27  their confidential underwriting files not be released to
28  licensed general lines agents registered pursuant to
29  sub-subparagraph b.
30         b.  By October 1, 2006, the corporation shall make
31  available to licensed general lines agents the registration

 1  procedures to be used to obtain confidential information from
 2  underwriting files for policies. As a condition of
 3  registration, the corporation shall require the licensed
 4  general lines agent to attest that the agent has the
 5  experience and relationships with authorized or surplus lines
 6  carriers to attempt to offer replacement coverage.
 7         c.  By January 1, 2007, the corporation shall make
 8  available through a secured website to licensed general lines
 9  agents registered pursuant to sub-subparagraph b. application,
10  rating, mitigation, and policy-type information relating to
11  all policies for which the policyholder has not requested that
12  the corporation withhold such information pursuant to
13  sub-subparagraph a. The licensed general lines agent
14  registered pursuant to sub-subparagraph b. may use such
15  information to contact and assist the policyholder in securing
16  replacement policies and the agent may disclose to the
17  policyholder that such information was obtained from the
18  corporation.
