11 Senators Garcia and Alexander moved the following amendment to
12 amendment (021596):

14 Senate Amendment (with title amendment)
15 On page 91, between lines 7 and 8,
16
17 insert:
18 (dd)1. For policies subject to nonrenewal as a result
19 of the risk being no longer eligible for coverage due to being
20 valued at $1 million or more, the corporation shall, directly
21 or through the market assistance plan, make information from
22 confidential underwriting and claims files of policyholders
23 available only to licensed general lines agents who register
24 with the corporation to receive such information according to
25 the following procedures:
26 2. By August 1, 2006, the corporation shall provide
27 such policyholders who are not eligible for renewal the
28 opportunity to request in writing, within 30 days after the
29 notification is sent, that information from their confidential
30 underwriting and claims files not be released to licensed
31 general lines agents registered pursuant to this paragraph.

1 3. By August 1, 2006, the corporation shall make
2 available to licensed general lines agents the registration
3 procedures to be used to obtain confidential information from
4 underwriting and claims files for such policies not eligible
5 for renewal. As a condition of registration, the corporation
6 shall require the licensed general lines agent to attest that
7 the agent has the experience and relationships with authorized
8 or surplus lines carriers to attempt to offer replacement
9 coverage for such policies.
10 4. By September 1, 2006, the corporation shall make
11 available through a secured website to licensed general lines
12 agents registered pursuant to this paragraph application,
13 rating, loss history, mitigation, and policy type information
14 relating to such policies not eligible for renewal and for
15 which the policyholder has not requested the corporation
16 withhold such information. The registered licensed general
17 lines agent may use such information to contact and assist the
18 policyholder in securing replacement policies and the agent
19 may disclose to the policyholder that such information was
20 obtained from the corporation.
