11 The Committee on Ways and Means (Fasano) recommended the
12 following amendment:

15 On page 100, line 23, through
16 page 102, line 2, delete those lines
17
18 and insert:
19 (1) The professional engineer or and professional
20 geologist shall perform such tests as sufficient, in their
21 professional opinion, to determine the presence or absence of
22 sinkhole loss or other cause of damage within reasonable
23 professional probability and for the professional engineer to
24 make recommendations regarding necessary building
25 stabilization and foundation repair.
26 Section 21. Subsections (1) and (2) of section
27 627.7073, Florida Statutes, are amended to read:
28 627.7073 Sinkhole reports.--
29 (1) Upon completion of testing as provided in s.
30 627.7072, the professional engineer or and professional
31 geologist shall issue a report and certification to the

1 insurer and the policyholder as provided in this section.
2 (a) Sinkhole loss is verified if, based upon tests
3 performed in accordance with s. 627.7072, a professional an
4 engineer or and a professional geologist issues issue a
5 written report and certification stating:
6 1. That the cause of the actual physical and
7 structural damage is sinkhole activity within a reasonable
8 professional probability.
9 2. That the analyses conducted were of sufficient
10 scope to identify sinkhole activity as the cause of damage
11 within a reasonable professional probability.
12 3. A description of the tests performed.
13 4. A recommendation by the professional engineer of
14 methods for stabilizing the land and building and for making
15 repairs to the foundation.
16 (b) If sinkhole activity is eliminated as the cause of
17 damage to the structure, the professional engineer or and
18 professional geologist shall issue a written report and
19 certification to the policyholder and the insurer stating:
20 1. That the cause of the damage is not sinkhole
21 activity within a reasonable professional probability.
22 2. That the analyses and tests conducted were of
23 sufficient scope to eliminate sinkhole activity as the cause
24 of damage within a reasonable professional probability.
25 3. A statement of the cause of the damage within a
26 reasonable professional probability.
27 4. A description of the tests performed.
28 (c) The respective findings, opinions, and
29 recommendations of the professional engineer or and
30 professional
