1 A bill to be entitled
2 An act relating to protective injunctions;
3 amending s. 784.046, F.S.; providing standing
4 for a governmental employer to seek an
5 injunction for protection against repeat
6 violence on behalf of an employee; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (a) of subsection (2) of section
12 784.046, Florida Statutes, is amended to read:
13 784.046 Action by victim of repeat violence, sexual
14 violence, or dating violence for protective injunction; powers
15 and duties of court and clerk of court; filing and form of
16 petition; notice and hearing; temporary injunction; issuance;
17 statewide verification system; enforcement.--
18 (2) There is created a cause of action for an
19 injunction for protection in cases of repeat violence, there
20 is created a separate cause of action for an injunction for
21 protection in cases of dating violence, and there is created a
22 separate cause of action for an injunction for protection in
23 cases of sexual violence.
24 (a) Any person who is the victim of repeat violence,
25 or the parent or legal guardian of any minor child who is
26 living at home and who seeks an injunction for protection
27 against repeat violence on behalf of the minor child, or any
28 governmental employer of any person who is the victim of
29 repeat violence in a public workplace who seeks an injunction
30 for protection against repeat violence on behalf of the
31 employee has standing in the circuit court to file a sworn

1 petition for an injunction for protection against repeat
2 violence.
3 Section 2. This act shall take effect upon becoming a
4 law.
