11  The Committee on Criminal Justice (Crist) recommended the
12  following amendment:

14         Senate Amendment 
15         On page 28, line 18, through
16            page 29, line 5, delete those lines
17  
18  and insert:  
19         (2)  The department and agency are authorized has
20  authority to adopt rules pursuant to ss. 120.536(1) and 120.54
21  to implement the provisions of this chapter. Such rules must
22  address the use of restraint and seclusion in forensic
23  facilities and must be consistent with recognized best
24  practices; prohibit inherently dangerous restraint or
25  seclusion procedures; establish limitations on the use and
26  duration of restraint and seclusion; establish measures to
27  ensure the safety of clients and staff during an incident of
28  restraint or seclusion; establish procedures for staff to
29  follow before, during, and after incidents of restraint or
30  seclusion; establish professional qualifications of and
31  training for staff who may order or be engaged in the use of

 1  restraint or seclusion; provide data-reporting and
 2  data-collection procedures relating to the use of restraint
 3  and seclusion; and provide for the documentation of the use of
 4  restraint or seclusion in the client's facility record.
