  1                      A bill to be entitled

  2         An act relating to evidence of theft or dealing

  3         in stolen property; amending s. 812.022, F.S.;

  4         providing that proof concerning the possession

  5         of a stolen motor vehicle having an ignition or

  6         steering wheel lock that has been bypassed or

  7         broken gives rise to an inference that the

  8         person possessing the motor vehicle knew or

  9         should have known that the vehicle was stolen;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Subsection (6) is added to section 812.022,

15  Florida Statutes, to read:

16         812.022  Evidence of theft or dealing in stolen

17  property.--

18         (6)  Proof that a person possesses a stolen motor

19  vehicle and that the ignition mechanism of the motor vehicle

20  has been bypassed or the locking mechanism of the steering

21  wheel of the motor vehicle has been broken or bypassed gives

22  rise to an inference that the person possessing the stolen

23  motor vehicle knew or should have known that the motor vehicle

24  was stolen.

25         Section 2.  This act shall take effect October 1, 2006.

28                          SENATE SUMMARY

29    For purposes of proving theft or possession of stolen
      property, provides that proof of possession of a stolen
30    motor vehicle having an ignition or steering wheel lock
      that has been bypassed or broken gives rise to an
31    inference that the person in possession of the vehicle
      knew or should have known that the vehicle was stolen.
