  1                      A bill to be entitled

  2         An act relating to evidence of theft or dealing

  3         in stolen property; amending s. 812.022, F.S.;

  4         providing that proof concerning the possession

  5         of a stolen motor vehicle having an ignition or

  6         steering wheel lock that has been bypassed or

  7         broken, unless satisfactorily explained, gives

  8         rise to an inference that the person possessing

  9         the motor vehicle knew or should have known

10         that the vehicle was stolen; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Subsection (6) is added to section 812.022,

16  Florida Statutes, to read:

17         812.022  Evidence of theft or dealing in stolen

18  property.--

19         (6)  Proof that a person possesses a stolen motor

20  vehicle and that the ignition mechanism of the motor vehicle

21  has been bypassed or the locking mechanism of the steering

22  wheel of the motor vehicle has been broken or bypassed, unless

23  satisfactorily explained, gives rise to an inference that the

24  person possessing the stolen motor vehicle knew or should have

25  known that the motor vehicle was stolen.

26         Section 2.  This act shall take effect October 1, 2006.
