  1                      A bill to be entitled

  2         An act relating to accessible parking spaces;

  3         amending s. 553.5041, F.S.; providing for

  4         reservation of accessible parking spaces for

  5         persons who require extra space in order to

  6         exit from or enter a motor vehicle; requiring

  7         signage; providing a penalty; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (7) is added to section

13  553.5041, Florida Statutes, to read:

14         553.5041  Parking spaces for persons who have

15  disabilities.--

16         (7)(a)  If a facility has more than one accessible

17  parking space pursuant to this section, at least 25 percent,

18  but no fewer than one space, must be reserved for the

19  temporary exclusive use of persons who have disabled parking

20  permits, who occupy a van or other vehicle having an attached

21  device to load or unload a wheelchair, and who require extra

22  space to deploy the mobility device, lift, ramp, or other

23  device in order to exit from or enter such vehicle. In

24  addition to any other signage requirements under this section

25  or ADAAG s. 4.30, such spaces must be posted with a sign

26  stating "VANS OR VEHICLES WITH ATTACHED WHEELCHAIR DEVICES"

27  and stating the penalty for illegal use of the space.

28         (b)  A person who parks in a space in violation of

29  paragraph (a) is subject to a fine of $500.

30         Section 2.  This act shall take effect July 1, 2006.
