11  Senator Wise moved the following amendment:

13         Senate Amendment 
14         On page 4, lines 14-29, delete those lines
15  
16  and insert:  
17         Section 4.  Subsections (1) and (2) of section 903.31,
18  Florida Statutes, are amended to read:
19         903.31  Canceling the bond.--
20         (1)  Within 10 business days after the conditions of a
21  bond have been satisfied or the forfeiture discharged or
22  remitted, the court shall order the bond canceled and, if the
23  surety has attached a certificate of cancellation to the
24  original bond, the clerk of the court shall furnish an
25  executed certificate of cancellation to the surety without
26  cost. An adjudication of guilt or innocence, an acquittal, or
27  a withholding of an adjudication of guilt of the defendant
28  shall satisfy the conditions of the bond. The original
29  appearance bond shall expire 36 months after such bond has
30  been posted for the release of the defendant from custody.
31  This subsection does not apply to cases in which a bond has

 1  been declared forfeited.
 2         (2)  The original appearance bond does shall not be
 3  construed to guarantee deferred sentences, appearance during
 4  or after a presentence investigation, appearance during or
 5  after appeals, conduct during or appearance after admission to
 6  a pretrial intervention program, payment of fines, or
 7  attendance at educational or rehabilitation facilities the
 8  court otherwise provides in the judgment. If the original
 9  appearance bond has been forfeited or revoked, the bond shall
10  not be reinstated without approval from the surety on the
11  original bond.
