6 rules for the implementation of the federal Law
7 Enforcement Officers Safety Act of 2004;
8 requiring the commission to develop and
9 authorize a uniform firearms proficiency
10 verification card to be issued to persons who
11 pass the firing range component of the firearms
12 proficiency course; authorizing the use of
13 specified facilities operating firing ranges
14 for testing of persons other than law
15 enforcement officers; providing an effective
16 date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Section 943.132, Florida Statutes, is
21 created to read:
22 943.132 Implementation of federal Law Enforcement
23 Officers Safety Act of 2004.--
24 (1) The commission shall by rule establish the manner
25 in which Title 18, 44 U.S.C. ss. 926B and 926C, the federal
26 Law Enforcement Officers Safety Act of 2004, relating to the
27 carrying of concealed firearms by qualified law enforcement
28 officers and qualified retired law enforcement officers, as
29 defined in the act, shall be implemented in the state. In
30 order to facilitate the implementation within the state of
31 Title 18, 44 U.S.C. ss. 926B and 926C, the commission shall

1 develop and authorize a uniform firearms proficiency
2 verification card to be issued to persons who achieve a
3 passing score on the firing range testing component of the
4 minimum firearms proficiency course for active law enforcement
5 officers, indicating the person's name and the date upon which
6 he or she achieved the passing score. Each such card shall be
7 issued only by firearms instructors certified by the
8 commission.
9 (2) Facilities operating firing ranges on which
10 firearms instructors certified by the commission administer
11 the firing range testing component of the minimum firearms
12 proficiency course for active law enforcement officers may
13 open the firing range under terms and conditions established
14 by the operating entity to other persons for purposes of
15 allowing such persons to demonstrate their ability to achieve
16 a passing score on the firing range testing component of the
17 minimum firearms proficiency course. All costs associated with
18 the demonstration by any such person that he or she meets the
19 requirements of the firing range testing component of the
20 minimum firearms proficiency course shall be at the expense of
21 the person being tested.
22 Section 2. This act shall take effect July 1, 2006.

24 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

27 - The bill amends the term "range instructor" to become
"firearms instructor," in keeping with the technical
28 title for these certified instructors.
29 - The bill amends language to clarify that FDLE's role in
implementing the federal Law Enforcement Officer Safety
30 Act of 2004 is limited to providing the opportunity to
persons qualified under that Act to meet a statewide
31 standard for firearm proficiency and be issued an
identification card upon doing so.
