1 A bill to be entitled
2 An act relating to optional Medicaid services;
3 amending s. 409.906, F.S.; authorizing the
4 Agency for Health Care Administration to pay
5 for certain adult dental services beginning on
6 a specified date; authorizing the agency to pay
7 for certain adult hearing services; authorizing
8 the agency to pay for certain adult visual
9 services; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Paragraph (b) of subsection (1) of section
14 409.906, Florida Statutes, is amended, and subsections (26)
15 and (27) are added to that section, to read:
16 409.906 Optional Medicaid services.--Subject to
17 specific appropriations, the agency may make payments for
18 services which are optional to the state under Title XIX of
19 the Social Security Act and are furnished by Medicaid
20 providers to recipients who are determined to be eligible on
21 the dates on which the services were provided. Any optional
22 service that is provided shall be provided only when medically
23 necessary and in accordance with state and federal law.
24 Optional services rendered by providers in mobile units to
25 Medicaid recipients may be restricted or prohibited by the
26 agency. Nothing in this section shall be construed to prevent
27 or limit the agency from adjusting fees, reimbursement rates,
28 lengths of stay, number of visits, or number of services, or
29 making any other adjustments necessary to comply with the
30 availability of moneys and any limitations or directions
31 provided for in the General Appropriations Act or chapter 216.

1 If necessary to safeguard the state's systems of providing
2 services to elderly and disabled persons and subject to the
3 notice and review provisions of s. 216.177, the Governor may
4 direct the Agency for Health Care Administration to amend the
5 Medicaid state plan to delete the optional Medicaid service
6 known as "Intermediate Care Facilities for the Developmentally
7 Disabled." Optional services may include:
8 (1) ADULT DENTAL SERVICES.--
9 (b) Beginning July 1, 2006 January 1, 2005, the agency
10 may pay for full and partial dentures, the procedures required
11 to seat dentures, and the repair and reline of dentures,
12 provided by or under the direction of a licensed dentist, for
13 a recipient who is 21 years of age or older.
14 (26) ADULT HEARING SERVICES.--The agency may pay for
15 hearing and related services, including hearing evaluations,
16 hearing aid devices, dispensing of the hearing aid, and
17 related repairs, if provided to a recipient 21 years of age or
18 older by a licensed hearing aid specialist, otolaryngologist,
19 otologist, audiologist, or physician.
20 (27) ADULT VISUAL SERVICES.--The agency may pay for
21 visual examinations, eyeglasses, and eyeglass repairs for a
22 recipient 21 years of age or older, if they are prescribed by
23 a licensed physician specializing in diseases of the eye or by
24 a licensed optometrist.
25 Section 2. This act shall take effect July 1, 2006.

29 Authorizes the Agency for Health Care Administration to
begin paying for certain adult dental services on a
30 specified date. Authorizes the agency to pay for certain
adult hearing services and certain adult visual services.
