11  The Committee on Education (Baker) recommended the following

15         On page 18, line 16, through
16            page 22, line 15, delete those lines

18  and insert:  Paragraph (f) of subsection (4) and subsection
19  (16) of section 1001.42, Florida Statutes, are amended, and
20  paragraph (c) of subsection (5) of that section, is repealed,
21  to read:
22         1001.42  Powers and duties of district school
23  board.--The district school board, acting as a board, shall
24  exercise all powers and perform all duties listed below:
25         (4)  ESTABLISHMENT, ORGANIZATION, AND OPERATION OF
26  SCHOOLS.--Adopt and provide for the execution of plans for the
27  establishment, organization, and operation of the schools of
28  the district, including, but not limited to, the following:
29         (f)  Opening and closing of schools; fixing uniform
30  date.--Adopt policies for the opening and closing of schools
31  and fix uniform dates. The opening date of the school year for

Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. PCS for SB 2048 (300232) Barcode 330476 1 schools in the district shall be no earlier than 7 days before 2 Labor Day each year; however, the district school board may, 3 with a supermajority vote after a public hearing, establish an 4 earlier opening date that shall be no earlier than August 8 or 5 establish a different opening date for a school on a 6 year-round or an extended calendar. 7 (5) PERSONNEL.-- 8 (c) Fully support and cooperate in the application of 9 the guiding principles of Better Educated Students and 10 Teachers (BEST) Florida Teaching, pursuant to s. 1000.041. 11 (16) IMPLEMENT SCHOOL IMPROVEMENT AND 12 ACCOUNTABILITY.--Maintain a system of school improvement and 13 education accountability as provided by statute and State 14 Board of Education rule. This system of school improvement and 15 education accountability shall be consistent with, and 16 implemented through, the district's continuing system of 17 planning and budgeting required by this section and ss. 18 1008.385, 1010.01, and 1011.01. This system of school 19 improvement and education accountability shall include, but is 20 not limited to, the following: 21 (a) School improvement plans.--Annually approve and 22 require implementation of a new, amended, or continuation 23 school improvement plan for each school in the district. 24 except that A district school board may establish a district 25 school improvement plan that includes all schools in the 26 district operating for the purpose of providing educational 27 services to youth in Department of Juvenile Justice programs. 28 Such plan shall be designed to achieve the state education 29 priorities pursuant to s. 1000.03(5) and student performance 30 standards. Professional development that supports enhanced and 4 differentiated instructional strategies to improve teaching 5 and learning. 6 2. Continuous use of disaggregated student achievement 7 data to determine effectiveness of instructional strategies. 8 3. Ongoing informal and formal assessments to monitor 9 individual student progress, including progress toward mastery 10 of the Sunshine State Standards, and to redesign instruction 11 if needed. 12 4. Alternative instructional delivery methods to 13 support remediation, acceleration, and enrichment strategies. 14 15 District school boards shall require schools to address other 16 matters of resource allocation as appropriate, such as 17 instructional materials and technologies that enhance teaching 18 and learning, staffing, student support services, school 19 safety and discipline strategies, student health and fitness, 20 and parental involvement. In addition, any school required to 21 implement a rigorous reading requirement pursuant to s. 22 1003.415 must include such component in its school improvement 23 plan. Each plan shall also address issues relative to budget, 24 training, instructional materials, technology, staffing, 25 student support services, specific school safety and 26 discipline strategies, student health and fitness, including 27 physical fitness, parental information on student health and 28 fitness, and indoor environmental air quality, and other 29 matters of resource allocation, as determined by district 30 school board policy, and shall be based on an analysis of 31 student achievement and other school performance data. 3 12:33 PM 04/03/06 s2048c-ed20-t01

In the event a district school board 4 does not approve a school improvement plan after exhausting 5 this process, the Department of Education shall be notified of 6 the need for assistance. 7 (c) Assistance and intervention.-- 8 1. Develop a 2-year plan of increasing individualized 9 assistance and intervention for each school in danger of not 10 meeting state standards or making adequate progress, as 11 defined pursuant to statute and State Board of Education rule, 12 toward meeting the goals and standards of its approved school 13 improvement plan. 14 2. Provide assistance and intervention to a school 15 that is designated with a identified as being in performance 16 grade of category "D" pursuant to s. 1008.34 and is in danger 17 of failing. 18 3. Develop a plan to encourage teachers with 19 demonstrated mastery in improving student performance to 20 remain at or transfer to a school with a designated as 21 performance grade of category "D" or "F" or to an alternative 22 school that serves disruptive or violent youths. If a 23 classroom teacher, as defined by s. 1012.01(2)(a), who meets 24 the definition of teaching mastery developed according to the 25 provisions of this paragraph, requests assignment to a school 26 designated with a as performance grade of category "D" or "F" 27 or to an alternative school that serves disruptive or violent 28 youths, the district school board shall make every practical 29 effort to grant the request. 30 4. Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. PCS for SB 2048 (300232) Barcode 330476 1 instruction categorical fund under s. 1011.62(1)(f) to improve 2 student performance in schools that receive a performance 3 grade category designation of "D" or "F." 4 (d) After 2 years.--Notify the Commissioner of 5 Education and the State Board of Education in the event any 6 school does not make adequate progress toward meeting the 7 goals and standards of a school improvement plan by the end of 8 2 years of failing to make adequate progress and proceed 9 according to guidelines developed pursuant to statute and 10 State Board of Education rule. School districts shall provide 11 intervention and assistance to schools in danger of being 12 designated with a as performance grade of category "F," 13 failing to make adequate progress. 14 (e) Public disclosure.--Provide information regarding 15 performance of students and educational programs as required 16 pursuant to ss. 1008.22 and 1008.385 and implement a system of 17 school reports as required by statute and State Board of 18 Education rule that shall include schools operating for the 19 purpose of providing educational services to youth in 20 Department of Juvenile Justice programs, and for those 21 schools, report on the elements specified in s. 1003.52(19). 22 Annual public disclosure reports shall be in an easy-to-read 23 report card format and shall include the school's student and 24 school performance grade, high school graduation rate 25 calculated without GED tests, disaggregated by student 26 ethnicity, category designation and performance data as 27 specified in state board rule. 28 (f) School improvement funds.--Provide funds to 29 schools for developing and implementing school improvement 30 plans.
