1 A bill to be entitled
2 An act relating to the Florida Long-term Care
3 Partnership Program; amending s. 409.9102,
4 F.S.; requiring the Department of Children and
5 Family Services, the Office of Insurance
6 Regulation within the Department of Financial
7 Services, and the Agency for Health Care
8 Administration to adopt rules for administering
9 the program; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 409.9102, Florida Statutes, is
14 amended to read:
15 409.9102 Florida Long-term Care Partnership Program.--
16 (1) The Agency for Health Care Administration is
17 directed to establish the Florida Long-term Care Partnership
18 Program, which shall:
19 (a)(1) Provide incentives for an individual to obtain
20 insurance to cover the costs of long-term care.
21 (b)(2) Establish standards for long-term care
22 insurance policies for designation as approved long-term care
23 partnership program policies in consultation with the Office
24 of Insurance Regulation.
25 (c)(3) Provide a mechanism to qualify for coverage of
26 the costs of long-term care needs under Medicaid without first
27 being required to substantially exhaust his or her resources,
28 including a reduction of the individual's asset valuation by
29 $1 for each $1 of benefits paid out under the individual's
30 approved long-term care partnership program policy as a
31 determination of Medicaid eligibility.

1 (d)(4) Provide and approve long-term care partnership
2 plan information distributed to individuals through insurance
3 companies offering approved partnership policies.
4 (e)(5) Alleviate the financial burden on the state's
5 medical assistance program by encouraging the pursuit of
6 private initiatives.
7 (2) The Department of Children and Family Services,
8 the Office of Insurance Regulation within the Department of
9 Financial Services, and the Agency for Health Care
10 Administration shall adopt rules pursuant to ss. 120.536(1)
11 and 120.54 to administer the Florida Long-term Care
12 Partnership Program.
13 Section 2. This act shall take effect July 1, 2006.
