1 A bill to be entitled
2 An act relating to the practice of architecture
3 and interior design; amending s. 481.203, F.S.;
4 defining the term "responsible supervising
5 control"; amending s. 481.205, F.S.;
6 authorizing the Board of Architecture and
7 Interior Design to adopt certain rules;
8 amending s. 481.223, F.S.; authorizing certain
9 architects to use the title "Architect,
10 Retired"; authorizing certain interior
11 designers to use the title "Interior Designer,
12 Retired"; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Subsection (16) is added to section
17 481.203, Florida Statutes, to read:
18 481.203 Definitions.--As used in this part:
19 (16) "Responsible supervising control" means the
20 exercise of direct personal supervision and control throughout
21 the preparation of documents, instruments of service, or any
22 other work requiring the seal and signature of a licensee
23 under this part.
24 Section 2. Subsection (4) is added to section 481.205,
25 Florida Statutes, to read
26 481.205 Board of Architecture and Interior Design.--
27 (4) The board may establish by rule minimum
28 procedures, documentation, and other requirements for
29 indicating evidence of the exercise of responsible supervising
30 control by a person licensed under this part in connection

1 with work performed both inside and outside the licensee's
2 office.
3 Section 3. Subsection (1) of section 481.223, Florida
4 Statutes, is amended to read:
5 481.223 Prohibitions; penalties; injunctive relief.--
6 (1) A person may not knowingly:
7 (a) Practice architecture unless the person is an
8 architect or a registered architect; however, a licensed
9 architect who has been licensed by the board and who chooses
10 to relinquish or not to renew his or her license may use the
11 title "Architect, Retired" but may not otherwise render any
12 architectural services.;
13 (b) Practice interior design unless the person is a
14 registered interior designer unless otherwise exempted herein;
15 however, an interior designer who has been licensed by the
16 board and who chooses to relinquish or not to renew his or her
17 license may use the title "Interior Designer, Retired" but may
18 not otherwise render any interior design services.
19 (c) Use the name or title "architect" or "registered
20 architect," or "interior designer" or "registered interior
21 designer," or words to that effect, when the person is not
22 then the holder of a valid license issued pursuant to this
23 part.;
24 (d) Present as his or her own the license of another.;
25 (e) Give false or forged evidence to the board or a
26 member thereof.;
27 (f) Use or attempt to use an architect or interior
28 designer license that has been suspended, revoked, or placed
29 on inactive or delinquent status.;
30 (g) Employ unlicensed persons to practice architecture
31 or interior design.; or

1 (h) Conceal information relative to violations of this
2 part.
3 Section 4. This act shall take effect July 1, 2006.

COMMITTEE SUBSTITUTE FOR

8 The CS revises the definition of "responsible supervising
control" and authorizes the Board of Architecture and Interior
9 Design to adopt rules governing the exercise of responsible
supervising control by licensed architects and interior
10 designers.
