1 A bill to be entitled
2 An act relating to the Motor Fuel Marketing
3 Practices Act; repealing ss. 526.303(4), (6),
4 (7), (9), and (11), 526.304, and 526.309, F.S.,
5 relating to the constraints on competition in
6 the retail sale of motor fuel; deleting
7 provisions prohibiting certain predatory
8 practices; amending s. 526.305, F.S.;
9 conforming a cross-reference; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsections (4), (6), (7), (9), and (11) of
15 section 526.303, Florida Statutes, are repealed.
16 Section 2. Section 526.304, Florida Statutes, is
17 repealed.
18 Section 3. Subsection (3) of section 526.305, Florida
19 Statutes, is amended to read:
20 526.305 Discriminatory practices unlawful;
21 exceptions.--
22 (3) Subject to the limitations of s. 526.304(3), A
23 sale made in good faith to meet an equally low price of a
24 competitor selling motor fuel of like grade which can be used
25 in the same motor vehicle is not a violation of this section.
26 Section 4. Section 526.309, Florida Statutes, is
27 repealed.
28 Section 5. This act shall take effect upon becoming a
29 law.
