1 A bill to be entitled
2 An act relating to voter registration; amending
3 s. 372.574, F.S.; requiring subagents appointed
4 by the Fish and Wildlife Conservation
5 Commission for the sale of hunting, fishing,
6 and trapping licenses and permits to provide
7 individuals seeking such licenses and permits
8 the opportunity to register to vote or to
9 update a voter registration; requiring
10 supervisors of elections to provide such
11 subagents with the necessary voter registration
12 applications; providing penalties; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Section 372.574, Florida Statutes, is
18 amended to read:
19 372.574 Appointment of subagents for the sale of
20 hunting, fishing, and trapping licenses and permits; voter
21 registration duties.--
22 (1) Subagents shall serve at the pleasure of the
23 commission. The commission may establish, by rule, procedures
24 for the selection and appointment of subagents. The following
25 are requirements for subagents so appointed:
26 (a) The commission may require each subagent to post
27 an appropriate bond as determined by the commission, using an
28 insurance company acceptable to the commission. In lieu of
29 the bond, the commission may purchase blanket bonds covering
30 all or selected subagents or may allow a subagent to post
31 other security as required by the commission.

1 (b) A subagent may sell licenses and permits as
2 authorized by the commission at specific locations within the
3 county and in states as will best serve the public interest
4 and convenience in obtaining licenses and permits. The
5 commission may prohibit subagents from selling certain
6 licenses or permits.
7 (c) It is unlawful for any person to handle licenses
8 or permits for a fee or compensation of any kind unless he or
9 she has been appointed as a subagent.
10 (d) Any person who willfully violates any of the
11 provisions of this section commits a misdemeanor of the second
12 degree, punishable as provided in s. 775.082 or s. 775.083.
13 (e) A subagent may charge and receive as his or her
14 compensation 50 cents for each license or permit sold. This
15 charge is in addition to the sum required by law to be
16 collected for the sale and issuance of each license or permit.
17 (f) A subagent shall submit payment for and report the
18 sale of licenses and permits to the commission as prescribed
19 by the commission.
20 (2) The Fish and Wildlife Conservation Commission or
21 any other law enforcement agency may carry out any
22 investigation necessary to secure information required to
23 carry out and enforce this section.
24 (3) All social security numbers that are provided
25 pursuant to ss. 372.561 and 372.57 and are contained in
26 records of any subagent appointed under this section are
27 confidential as provided in those sections.
28 (4)(a) All subagents appointed under this section
29 shall provide the opportunity to register to vote or to update
30 a voter registration record to each individual who comes to
31 the subagent to purchase any resident hunting license, fishing

1 license, combination license, or trapping permit. Each
2 subagent shall provide each individual with a voter
3 registration application, which shall be provided to the
4 subagent by the voter registration office in the subagent's
5 county.
6 (b) Within 30 days after the effective date of this
7 act, each supervisor of elections shall provide an appropriate
8 supply of voter registration applications to each subagent in
9 that supervisor's county and thereafter at the request of the
10 subagent along with appropriate contact information for each
11 subagent to request additional applications.
12 (c) Failure to comply with any provision of this
13 subsection by any subagent or supervisor of elections shall
14 constitute a civil infraction subject to a minimum fine of
15 $500 for the first infraction, $1,000 for the second
16 infraction, and $2,500 for each subsequent infraction.
17 Section 2. This act shall take effect upon becoming a
18 law.
