  2         An act relating to voter registration; creating

  3         s. 97.05831, F.S.; requiring the supervisor of

  4         elections of each county to send voter

  5         registration applications to the Fish and

  6         Wildlife Conservation Commission and its

  7         subagents; amending s. 372.561, F.S.; requiring

  8         voter registration applications to be displayed

  9         at each location where hunting, fishing, or

10         trapping licenses or permits are sold;

11         requiring that applicants for hunting, fishing,

12         or trapping licenses or permits be asked if

13         they would like a voter registration

14         application; requiring that certain information

15         be provided when a person applies for a

16         hunting, fishing, or trapping license or permit

17         via the Internet; providing effective dates.

19  Be It Enacted by the Legislature of the State of Florida:

20  

21         Section 1.  Section 97.05831, Florida Statutes, is

22  created to read:

23         97.05831  Voter registration applications made

24  available to the Fish and Wildlife Conservation

25  Commission.--As required in s. 372.561, each supervisor of

26  elections shall supply voter registration applications to the

27  Fish and Wildlife Conservation Commission and its subagents,

28  as needed.

29         Section 2.  Subsection (8) of section 372.561, Florida

30  Statutes, is renumbered as subsection (10), and new

31  subsections (8) and (9) are added to that section, to read:

 1         372.561  Recreational licenses, permits, and

 2  authorization numbers to take wild animal life, freshwater

 3  aquatic life, and marine life; issuance; costs; reporting.--

 4         (8)  At each location where hunting, fishing, or

 5  trapping licenses or permits are sold, voter registration

 6  applications shall be displayed and made available to the

 7  public. Subagents shall ask each person who applies for a

 8  hunting, fishing, or trapping license or permit if he or she

 9  would like a voter registration application and may provide

10  such application to the license or permit applicant but shall

11  not assist such persons with voter registration applications

12  or collect complete or incomplete voter registration

13  applications.

14         (9)  When acting in its official capacity pursuant to

15  this section, neither the commission nor a subagent is deemed

16  a third-party registration organization, as defined in s.

17  97.021(36), or a voter registration agency, as defined in s.

18  97.021(40), and is not authorized to solicit, accept, or

19  collect voter registration applications or provide voter

20  registration services.

21         Section 3.  Effective October 1, 2006, subsection (9)

22  of section 372.561, Florida Statutes, as created by this act,

23  is renumbered as subsection (11), subsection (10) of that

24  section is renumbered as subsection (13), and new subsections

25  (9), (10), and (12) are added to that section, to read:

26         372.561  Recreational licenses, permits, and

29         (9)  Except as provided in subsections (8) and (12),

30  each person who applies for a hunting, fishing, or trapping

31  license or permit shall be asked if he or she would like the

 1  appropriate supervisor of elections to provide a voter

 2  registration application to the applicant at a later date. If

 3  at the time a license is purchased the applicant indicates

 4  that he or she would like to receive a voter registration

 5  application, the commission shall, within 7 days, make the

 6  request available to the appropriate supervisor of elections

 7  or voter registration agency so that an application may be

 8  sent to the applicant. Supervisors of elections shall mail an

 9  application to each person requesting such application within

10  5 business days after receipt of the request.

11         (10)  The commission may satisfy the requirements of

12  subsection (9) by providing access to an Internet site that

13  contains the voter registration information.

14         (12)  Each person who applies for a hunting, fishing,

15  or trapping license or permit via the Internet shall be

16  provided a link to the Department of State's online uniform

17  statewide voter registration application.

18         Section 4.  Except as otherwise expressly provided in

19  this act, this act shall take effect upon becoming a law.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 208

 3                                 

 4  The committee substitute would require the supervisors of
    elections to supply voter registration applications to the
 5  FWCC and their subagents.  Each FWCC subagent would be
    required to ask each individual who purchases a license or
 6  permit if they would like a voter registration application and
    to make voter registration applications available.
 7  Clarification is added which prohibits the subagents from
    assisting people with the voter registration application or
 8  collecting completed applications.  The committee substitute
    further clarifies that the FWCC and its subagents are not
 9  voter registration agencies or third-party registration
    organizations and are thus prohibited from soliciting,
10  accepting, or collecting voter registration applications or
    providing voter registration services.

    The committee substitute provides for a series of procedures
12  to govern the transmission of voter registration applications
    between the FWCC, its subagents and supervisors of elections.

    The committee substitute removes the provision that subagents
14  who fail to provide the proper voter registration information
    and forms and county supervisors of elections who fail to send
15  the registration forms would face monetary civil penalties.
