12 recommended the following amendment:

14 Senate Amendment (with title amendment)
15 Delete everything after the enacting clause
16
17 and insert:
18 Section 1. The Office of Program Policy Analysis and
19 Government Accountability and the Auditor General shall
20 jointly review the Office of Tourism, Trade and Economic
21 Development, the Black Business Investment Board, its
22 subsidiaries or affiliates, and the Black Business Investment
23 Corporations in the individual and collective performance of
24 their statutory and contract duties imposed under ss.
25 288.707-714, F.S. In particular, the study shall evaluate the
26 following:
27 (1) Compliance with applicable statutes and
28 contractual provisions;
29 (2) Program performance, including the number of loans
30 or loan guarantees made, the performance of said loans or loan
31 guarantees, and the retention or lack of retention of loan or

1 loan guarantee customers for fiscal years 2001-2002 through
2 2005-2006;
3 (3) Accountability, including the uniformity and
4 quality of record keeping by each participant so that state
5 funds may be tracked effectively;
6 (4) Organizational issues, including how the structure
7 of the governing laws and contractual relationships assisted
8 or hindered the implementation of the program;
9 (5) Investment activity, including investments in
10 non-black business enterprises and use of state funds for
11 other than loan or loan guarantee origination to black
12 business enterprises;
13 (6) Business relationships between the program
14 participants, including agreements between program
15 participants, their board members, officers or employees and
16 third parties that benefit the participants or board members,
17 officers or employees in ways that do not enhance the program;
18 (7) Oversight by the Office of Tourism, Trade and
19 Economic Development, including on the use of contractual
20 provisions to enhance accountability;
21 (8) Performance of statutory certification required
22 under s. 288.70 91(1), by program participants; and
23 (9) Accountability for appropriated funds as required
24 by s. 288.7091(2), by program participants.

26 The two offices shall provide a report of their findings and
27 recommendations for legislative changes to the program by
28 January 1, 2007 to the Governor, the President of the Senate,
29 the Speaker of the House of Representatives and the
30 appropriate committee chairs of the Senate and the House of
31 Representatives.

11 An act relating to economic development;
12 requiring the Office of Program Policy Analysis

14 General to jointly review the Office of
15 Tourism, Trade and Economic Development, the
16 Black Business Investment Board, its
17 subsidiaries or affiliates, and the Black
18 Business Investment Corporations; providing an
19 effective date.
