11  The Committee on Health Care (Jones) recommended the following
12  amendment:

14         Senate Amendment (with title amendment) 
15         On page 3, line 15,

17  insert:  
18         Section 1.  Subsection (16) is added to section
19  627.732, Florida Statutes, to read:
20         627.732  Definitions.--As used in ss. 627.730-627.7405,
21  the term:
22         (16)  "Diagnostic testing facility" means a person,
23  partnership, firm, or other business entity that performs the
24  technical component of magnetic imaging, static radiographs,
25  computer tomography, and positron emission tomography, and
26  provides the professional component of the service through an
27  employee or independent contractor in a fixed facility that is
28  accredited by the Joint Commission on Accreditation of
29  Healthcare Organizations and the American College of Radiology
30  within 1 year after licensure and:
31         (a)  Does not accept referrals prohibited by s.

 1  456.053(5).
 2         (b)  Does not directly or indirectly provide therapy or
 3  treatment services to patients for which it also provides
 4  diagnostic imaging services.
 5         (c)  Does not include any entity that has an investor
 6  as defined in s. 456.053(3), excluding any one of the
 7  following:
 8         1.  Any person or entity that is directly or indirectly
 9  an investor in a health care clinic as defined in s. 400.9905,
10  or
11         2.  Any person or entity that directly or indirectly
12  provides services to a clinic if such services include the
13  referral as defined by s. 456.053(3) to patients of any
14  provider of diagnostic imaging services.
