11 The Committee on Health Care (Jones) recommended the following
12 amendment:

15 On page 8, lines 3-27, delete those lines
16
17 and insert:
18 (5) NONREIMBURSABLE SERVICES.--The Department of
19 Health, in consultation with the appropriate professional
20 licensing boards, shall adopt, by rule, a list of diagnostic
21 tests deemed not to be medically necessary for use in the
22 treatment of persons sustaining bodily injury covered by
23 personal injury protection benefits under this section. The
24 list shall be revised from time to time as determined by the
25 Department of Health in consultation with the respective
26 professional licensing boards. Inclusion of a test on the list
27 of invalid diagnostic tests shall be based on lack of
28 demonstrated medical value and a level of general acceptance
29 by the relevant provider community and is not dependent for
30 results entirely upon subjective patient response.
31 Notwithstanding its inclusion on a fee schedule in this

1 section, an insurer or insured is not required to pay any
2 charge or reimburse claims for any invalid diagnostic test as
3 determined by the Department of Health.
