11 The Committee on Banking and Insurance (Baker) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 49, between lines 22 and 23,
16
17 insert:
18 (23) CONSOLIDATION OF LAWSUITS.--In an effort to avoid
19 unnecessary, piecemeal litigation and expedite the
20 administration of justice in bringing causes to a quicker and
21 less expensive conclusion, all issues, which include all
22 benefits claimed, under this section regarding a specific
23 claimant for a particular date of loss which are, or with due
24 diligence could have been, identified must be brought at the
25 same time and consolidated into one cause of action. Any award
26 of attorney's fees resulting from a party prevailing in an
27 action under this section shall be limited to one fee
28 corresponding to the attorney who initially filed the lawsuit.
29 In this regard, any holder of an assignment of benefits shall
30 be held to the same requirements set forth in this subsection
31 as if the claim were being litigated by the insured.
