11  The Committee on Banking and Insurance (Baker) recommended the
12  following amendment:

14         Senate Amendment (with title amendment) 
15         On page 49, between lines 22 and 23,
16  
17  insert:  
18         (23)  INTERPLEADER.--An action for interpleader or in
19  the nature of interpleader may be brought against two or more
20  adverse claimants who claim or may claim entitlement to
21  benefits that may be available pursuant to a policy of
22  insurance. The claims of the several defendants need not have
23  a common origin or be identical but may be adverse to and
24  independent of each other. The plaintiff may deny liability in
25  whole or in part to any or all of the defendants. A defendant
26  may likewise obtain interpleader by way of counterclaim or
27  cross-claim. The complaint for interpleader shall specify the
28  nature and value of the benefits and must be accompanied by
29  payment or tender into court of the benefits available. The
30  complaint may request, and the court may grant prior to the
31  entry of an order of interpleader, appropriate ancillary
