1 A bill to be entitled
2 An act relating to dart-firing stun guns;
3 creating s. 943.1717, F.S.; providing
4 circumstances during which law enforcement,
5 correctional, and correctional probation
6 officers may employ a dart-firing stun gun;
7 requiring the Criminal Justice Standards and
8 Training Commission to establish standards for
9 instruction in the use of dart-firing stun guns
10 in self defense and in the use of deadly force;
11 requiring that a minimum number of hours in
12 such training be included in the basic-skills
13 course required for certification; providing an
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Section 943.1717, Florida Statutes, is
19 created to read:
20 943.1717 Use of dart-firing stun guns.--
21 (1) A law enforcement, correctional, or correctional
22 probation officer's decision to use a dart-firing stun gun
23 must involve an arrest or a custodial situation during which
24 the person who is the subject of the arrest or custody
25 escalates resistance to the officer from passive physical
26 resistance to active physical resistance and the person:
27 (a) Has the apparent ability to physically threaten
28 the officer or others; or
29 (b) Is preparing or attempting to flee or escape.
30 (2) The Criminal Justice Standards and Training
31 Commission shall establish standards for instructing law

1 enforcement, correctional, and correctional probation officers
2 in the use of dart-firing stun guns in self-defense and in the
3 use of deadly force. The instructional standards must include
4 the effect a dart-firing stun gun has on persons under the
5 influence of alcohol or drugs.
6 (3) Each basic-skills course required for
7 certification as a law enforcement, correctional, or
8 correctional probation officer must include instruction on the
9 use of dart-firing stun guns. The portion of the basic-skills
10 course on the use of stun guns must be a minimum of 4 hours'
11 duration.
12 (4) After completing the basic-skills course, each law
13 enforcement, correctional, and correctional probation officer
14 must complete an annual training course on the use of
15 dart-firing stun guns. The annual training course on the use
16 of stun guns must be a minimum of 1 hour duration.
17 Section 2. This act shall take effect upon becoming a
18 law.
