| 5 | (15) If the insurer agrees in writing to comply with the |
| 6 | recommendation of the neutral evaluator but the policyholder |
| 7 | declines to resolve the matter in accordance with the |
| 8 | recommendation of the neutral evaluator pursuant to this |
| 9 | section, the insurer is not liable for attorney's fees under s. |
| 10 | 627.428 or other provisions of the insurance code or for extra- |
| 11 | contractual damages related to a claim for a sinkhole loss |
| 12 | unless the policyholder obtains a judgment that exceeds the |
| 13 | value of any remedies contained in the recommendation of the |
| 14 | neutral evaluator. |
