11 The Committee on Education Appropriations (Wise) recommended
12 the following amendment:

14 Senate Amendment
15 Delete everything after the resolving clause
16
17 and insert:
18 That the following creation of Section 8 of Article IX
19 of the State Constitution is agreed to and shall be submitted
20 to the electors of this state for approval or rejection at the
21 next general election or at an earlier special election
22 specifically authorized by law for that purpose:
23 ARTICLE IX
24 EDUCATION
25 SECTION 8. Equal opportunity to obtain a high quality
26 education.--Every child deserves an equal opportunity to
27 obtain a high quality education, regardless of his or her
28 family's income, religion, or race.
29 (a) Funding for a high quality public K-12 education
30 through classroom instruction is fundamental. To make
31 adequate provision for a high quality public K-12 education,

1 the Legislature shall ensure that funding provided for public
2 schools shall primarily be used for classroom instruction
3 rather than administration. Classroom instruction and
4 administration shall be defined by law.
5 (b) Students in prekindergarten through college who
6 have disabilities, or are economically disadvantaged, or meet
7 other legislatively specified criteria, may participate, as
8 provided by law, in education programs that include nonpublic
9 schools. The legislature may enact and publicly fund
10 prekindergarten through college education programs, without
11 regard to the religious nature of any participant or nonpublic
12 provider, notwithstanding any other provision of this Article
13 or the last sentence of Section 3 of Article I of this
14 constitution.

16 Nothing in this section establishes a right to an education
17 program not provided by law.
18 BE IT FURTHER RESOLVED that the following statement be
19 placed on the ballot:
20 CONSTITUTIONAL AMENDMENT
21 ARTICLE IX, SECTION 8
22 EQUAL OPPORTUNITY TO OBTAIN A HIGH QUALITY EDUCATION.--
23 Proposing an amendment to the State Constitution to provide
24 that every child deserves an equal opportunity to obtain a
25 high quality education, regardless of his or her family's
26 income, religion, or race; to provide that funding for high
27 quality public K-12 education through classroom instruction is
28 fundamental; to provide that to make adequate provision for a
29 high quality public K-12 education, the Legislature shall
30 ensure that funding provided for public schools shall
31 primarily be used for classroom instruction rather than
