12 the following amendment:

15 On page 4, line 27,

17 insert:
18 Section 1. Subsection (3) is added to section 383.335,
19 Florida Statutes, to read:
20 383.335 Partial exemptions.--
21 (3) Any facility that is located in trauma district
22 17, owned and operated by a board-certified obstetrician as of
23 June 15, 2006, and subject to licensure under ss.
24 383.30-383.335 is exempt from the prohibition against
25 providing conduction anesthesia contained in s. 383.313(3) for
26 3 years. The facility must be located within 1 mile of a
27 hospital that has a neonatal intensive care unit and must have
28 a written transfer agreement with such hospital. Within the
29 first 24 months of operation, the agency shall review the
30 safety and outcome data for patients served in order to
31 determine the viability of statewide application of the

11 amending s. 383.335, F.S.; exempting certain
12 facilities from a provision prohibiting a birth
13 center from providing conduction anesthesia;
14 requiring that the Agency for Health Care
15 Administration review patient safety data for
16 purposes of determining the viability of
17 statewide application of the exemption;
