11  The Committee on Health Care (Saunders) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 5, between lines 21 and 22,
16  
17  insert:  
18         Section 5.  Present paragraphs (f)-(s) of subsection
19  (3) of section 408.036, Florida Statutes, are redesignated as
20  paragraphs (g)-(t), respectively, and a new paragraph (f) is
21  added to that subsection, to read:
22         408.036  Projects subject to review; exemptions.--
23         (3)  EXEMPTIONS.--Upon request, the following projects
24  are subject to exemption from the provisions of subsection
25  (1):
26         (f)  For the creation of a single nursing home within a
27  district by combining licensed beds from two or more licensed
28  nursing homes within such district, regardless of subdistrict
29  boundaries, if 50 percent of the beds in the created nursing
30  home are transferred from the only nursing home in a county
31  and its utilization data demonstrate that it had an occupancy

 1  rate of less than 75 percent for the 12-month period ending 90
 2  days before the request for the exemption. This paragraph
 3  shall be repealed upon the expiration of the moratorium
 4  established in s. 651.1185(1).

17         certificate of need from the Agency for Health
18         Care Administration; providing for future
19         repeal;
